Huchingson, County Administrative Officer · Subject: Approve Contract between the County of Lake and the Law Office of Pekin & Pekin for Indigent Defense Services; and Authorize County Administrative Officer to sign EXECUTIVE SUMMARY: The County is obligated by law to provide public defender services to those that cannot otherwise afford such defense services. Most indigent defendants are accommodated pursuant to the County's master public defense contract with Lake Legal Defense. Due to multiple conflicts of interest, Lake Legal Defense was not able to provide defense services in the case of homicide defendant Gary Williams. In addition to a homicide charge, this case also has special circumstance allegation and thus holds the potential for the death penalty.

Consequently, public defense services have been provided by an attorney working under a separate contract. That attorney, however, recently requested and was granted release from representation by the court, necessitating staff's search for another qualified attorney. Because of the seriousness of the charges, this case is likely to be protracted. In such instances, staff attempts to find a qualified attorney willing to accept a cap on their compensation. Although challenging, staff has identified an attorney, which the court has already appointed, who is willing to accept a rate of $80 per hour for the first $40,000 and thereafter a rate of $80 per hour not to exceed $10,000 per month. This compensation structure is consistent with the approach that staff has previously employed in such cases. Although the court has already made this appointment, staff believes this is the best deal that could have been negotiated even if more time had been provided by the court. Huchingson, County Administrative Officer · Subject: Consideration of Letter of Support for AB 1642 (Obernolte) to Extend the Period to Pay or Protest the State Fire Prevention Fee and Authorize the Chair to sign. EXECUTIVE SUMMARY: We have been approached by staff of Assemblyman Jay Obernolte's asking your Board to support Assembly Bill 1642, which would extend the period to pay or protest the State's Fire Prevention Fee from 30 days from the date of assessment to 60 days. This is similar to last year's AB 203 which was also introduced by Assemblyman Obernolte. Created by the Legislature and Governor as part of the 2011 Budget, the Fire Prevention Fee charges property owners $152.33 for each habitable structure located in a State Responsibility Area (SRA), with a $35 reduction if they live within the boundaries of a local fire protection district. About 700,000 rural Californians receive a yearly Fire Prevention Fee bill, due 30 days from the date on the notice. Due to the rural nature of those being billed, many individuals do not receive their bills in a timely manner. Additionally, many of these individuals are on fixed incomes, making it nearly impossible for them to pay their Fire Prevention Fee by the 30-day deadline. Increasing the payment due date of the Fire Prevention Fee from 30 to 60 days will ensure greater compliance with the law by giving all owners of habitable structures in an SRA more time to receive their bills. AB 1642 will also give those taxpayers on fixed incomes more time to adjust their budgets.

EXECUTIVE SUMMARY: Jessica Hamner, Program Coordinator in the Public Health Accreditation Program has been invited to attend an Open Forum for Quality Improvement (QI) in Public Health hosted by the National Network of Public Health Institutes (NNPHI). This workshop will share the Improvement Planning process and methods designed to use the collective thinking power of all employees, to align objectives and the supporting strategies and tactics for pursuing goals. Preparation for the accreditation process is a demanding effort. For some measures, a health department is not sure how to begin nor who to ask for assistance. This will be part of what Ms. Hamner will be introduced to. She will also be exposed to a health equity assessment tool among other items shared by representatives from accredited departments that can then be used here to analyze areas of opportunity for change. Attendance at the conference will provide excellent information, resources and guidance for our Department's strategic plan for National Public Health Accreditation. Travel and all associated costs, including airfare, meals, airline baggage fees, ground transportation, hotel and airport parking are covered by the National Network of Public Health Institutes and an Accreditation Support Initiative Grant from the National Association of City County Health Officials (NACCHO). There is no cost to the Department or to the County. As Health Services Director, I fully support Ms. Hamner's attendance. This workshop will share the Improvement Planning process and methods designed to use the collective thinking power of all employees, to align objectives and the supporting strategies and tactics for pursuing goals. Preparation for the accreditation process is a demanding effort. For some measures, a health department is not sure how to begin nor who to ask for assistance. This will be part of what Ms. Hamner will be introduced to. She will also be exposed to a health equity assessment tool among other items shared by representatives from accredited departments that can then be used here to analyze areas of opportunity for change. Attendance at the conference will provide excellent information, resources and guidance for our Department's strategic plan for National Public Health Accreditation. The terms approved by the Board were a payment-free and interest-free grace period of six months from the date of first waste disposal at the landfill with interest at an annual rate of 1.97% applied to the account balance following the six month grace period, and full account payment to be made no later than forty eight months following each waste disposal at the landfill. In order to secure those terms with Lake County Partners, and further ensure payment of all gate fees through a promissory note, staff prepared a draft agreement which was provided to Lake County Partners for review. Lake County Partners has since been sold to Hoberg's Historical Association (HHA), and staff has been unsuccessful negotiating a mutually amenable agreement. The agreement as proposed by the County is attached, as well as the most recent agreement as proposed by HHA with mark-ups shown. As of February 17, HHA has transported 890.72 tons of waste to the landfill amounting to an account balance of $45,533.63. HHA has not provided the requested estimate of remaining waste to be delivered to the landfill, but using their own previous estimate of "less than $200,000" equates to approximately 3,000 tons of remaining waste.

EXECUTIVE SUMMARY: The adopted FY 16/17 budget for the ISF Heavy Equipment Division of the Public Works Department includes an appropriation for the purchase of a pneumatic roller. During the mid-year budget, your Board increased that appropriation after staff was unsuccessful in locating a roller at the appropriated price. Staff has recently located a vendor in the Woodland area that sells used Caterpillar equipment, and they have the model roller we have specified at a very reasonable price. The roller is a 2011, with 529 hours and the engine is California Air Resources Board (CARB) compliant. The cost of the roller is $45,045.00 - including taxes. Staff has located similar used rollers out of State with prices ranging from $72,500 to $95,000, and we obtained a quote for a new roller of $120,000.

Recommendation

Staff recommends that the Board of Supervisors determine that a) due to the unique nature of the piece of equipment, and the fact the equipment is used and difficult to locate, it is in the public's interest to waive the normal bidding requirements for the purchase of the pneumatic roller, and b) to authorize the Public Works Director / Assistant Purchasing Agent to issue a purchase order not to exceed $45,045.00 to California Compaction Equipment, Inc.
