EXECUTIVE SUMMARY: This is the first in a series of Cannabis Workshops which is part of your approved work plan to finalize recreational cannabis provisions in Article 72 in a manner which is consistent with but not duplicative of state regulations. This first workshop shall be divided into two one-hour blocks. The first hour will include a report, by our consultant Mark Lovelace on the following topics: * Overview of state law and emergency regulations * Approaches taken in other areas including California counties, cities and other states * Cannabis market projections The second hour will include a report by Community Development Director Bob Massarelli on the draft local Commercial Cultivation Ordinance with a particular focus on certain decision points where Board direction is needed. At the close of the second hour, we will recommend that your Board direct staff to return, on your next regular agenda, with a Resolution of Intent to send the Commercial Cultivation Ordinance to the Planning Commission. Clerk’s notes: County Administrative Officer Carol Huchingson presented the item to the Board. Mark Lovelace was introduced to the Board as a Cannabis Policy Advisor for Hdl Companies. A PowerPoint presentation was given on the cannabis industry in California and the recent changes in regulation. Manufacturing has been added to the state license types. Also, Processor, Retail delivery only, self distribution and event organizer. A - Adult M - Medical 65 different state license types and 3 different state licensing agencies. CDFA, Public Health, Bureau of Cannabis Control (BCC). California Cannabis Market: Cannabis production: 13.5 million pounds, Consumption 2.5 million pounds (CDFA) and 1.6 million pounds (Ca. Cannabis Opportunity Report). Anticipated increase in consumption due to legalization: 9.4%. Adult use - 61.5%, Medical Use - 9%, Black Market -29.5%. Ca. Dept. of Food and Ag Survey, August 2016 - Anticipated number of cultivation licenses statewide: 14,277. Potential cannabis production: 30 - 40 million pounds. CDFA-State cultivation licenses issued Jan 16 - 432 licenses. Potential production from these licenses 0.84 to 1.1 million pounds. License Trends - Cottage -10, Specialty - 69, Small - 266, Medium - 77 (only 1 license allowed for Medium), Outdoor - 131, Indoor - 94, Mixed light tier 1 - 155, Mixed light tier 2 - 42. Community Development Director Bob Massarelli presented a PowerPoint Presentation on Cannabis Cultivation and a request for guidance from the BOS. Senior Planner Michelle Irace was also present. A resolution of intent to revise Article 27 - Use permits to regulate Cannabis. CDD has received a total of 22 self certification applications. 9 certificates of compliance have been issued. 3 incomplete letters have been sent for zoning issues. 7 noncompliance letters issued- mostly for fencing, dwelling, patient info avail. Gives 30 days to rectify. 1 site visit next week. 2 additional applications received. 13 state emails received regarding the temporary licenses program. Chair Steele asked if there was any public input.
