(a) This item is being submitted as an "extra" agenda item. The justification for this request to consider an item not on the posted agenda is as follows:
This item came to my attention subsequent to the posting of the current agenda and there is a need to take action before the next agenda.
(b) Last week, our Board approved and sent the attached letter to the Board of Barbering and Cosmetology, advocating for temporary lifting of restrictions, allowing local operators to work in the homes of their clients. Executive Officer Kristy Underwood responded with the attached letter yesterday, advising that her Board does not have the authority to lift or waive said restrictions. Ms. Underwood goes on to advise that this could be possible by an Executive Order of Governor Newsom.
Today, I am recommending our Board send a second letter directly to Governor Newsom requesting he issue an Executive Order giving this special temporary permission, not only during while present SIP orders are in place but to also allow this again, should future waves of the disaster necessitate closure of barber shops and hair salons.

Lake County Behavioral Health Services (LCBHS) uses two (2) psychiatric facilities: Adventist Health St. Helena and Adventist Health Vallejo. Both facilities provide Psychiatric Inpatient Hospital Services and Professional Services associated with Acute Inpatient Psychiatric Hospitalizations to clients referred by LCBHS. As LCBHS has had a successful ongoing working relationship with St. Helena Hospital and would like to continue this working relationship, LCBHS is requesting to waive the formal bidding process, pursuant to Lake County Code Section 38.2, as it is not in the public interest due to the unique nature of goods or services. AS LAW ENFORCEMENT OFFICERS WEEK
WHEREAS, From the Beginning of this Nation, law enforcement officers have played an important role in safeguarding the rights and freedoms which are guaranteed by the constitution and in protecting the lives and property of our citizens, and the operation of correctional and detention facilities housing millions of prisoner and detainees throughout the nation; and
WHEREAS, through constant application of new procedures and techniques, such officers are becoming more efficient in their enforcement of our laws and ensuring safety, containment and control of the human beings charged to their care, while sustaining uncompromised regard for their dignity and constitutional rights; and
WHEREAS, it is important that all citizens know and understand the duties, and responsibilities of their law enforcement agencies and the necessity for cooperating with them in maintaining law and order; and
WHEREAS, it is important that all citizens know and understand the extraordinary risks and sacrifices the dedicated men and women who have chosen law enforcement as a career face as they safeguard our freedom and security, and the public from the criminals in their custody while at the same time encouraging such prisoners to develop skills and attitudes that can help them become productive members of society after their release; and
WHEREAS, it is fitting and proper that we express our gratitude for the dedicated service and courageous deeds of law enforcement officers and for the contributions they have made to the security and well-being of all our people.
NOW, THEREFORE, BE IT PROCLAIMED by the Board of Supervisors of the County of Lake formally designates the week of May 3-9, 2020, as Law Enforcement Officers Week in Lake County and publicly salutes the service of law enforcement officers in our community and in communities across the nation.

Clerk’s notes: Public Health Officer, Dr. Gary Pace gave an update on the Covid-19 epidemic. The Public Health Department will start drive up testing for COVID-19 today with no doctor approval needed. The department will be able to administer up to 50 tests per day. Sheriff Brian Martin and Public Works Director Scott DeLeon spoke.
Chair Simon asked if anyone present wished to speak and the following people spoke via Zoom: Bryan Dobrowski, Sally Peterson, Mark and Lucia, Jonathan Cronan, Melissa Fulton, Eileen Anderson, Martha Mincer, Ron Green, Virginia, Frank DeLoso, Michael Green, Olga Martin Steele and Blake Davidson. On April 21, 2020 a letter was submitted by our Board to Governor Newsom requesting local control in reopening the economy while following Public Health Benchmarks and working with our Public Health Officer. This letter was not signed by our Public Health Officer, nor was it offered to our city jurisdictions for added support and solidarity on how all of Lake County feels about the best way to move forward. Should we consider expanding upon this letter and adding signatures?
Another idea is to gather support from surrounding counties. I've provided an example of a letter, similar to our April 21, 2020 letter to Governor Newsom requesting local control. This letter represents six counties and has been signed by the chair of 6 County Board of Supervisor chairs as well as 14 Mayors. Should we seek to mimic this letter and obtain the signatures of the north western counties of California requesting to obtain local control in reopening our economy?
This agenda item provides us with the ability to discuss what our next move is with our previous letter and future correspondence as we try to find ways to move forward and loosen the restrictions that are currently in place and obtain local control where we can make the best decisions for us rather than a one size fits all 4 phase action plan that covers all of the state of California.

While we are extremely grateful to our State Elected Leadership for their support as Lake County has weathered repeated disasters and substantial expense and revenue loss, the COVID-19 crisis poses an all new set of challenges.
Specifically, these letters request that counties with populations of less than 500,000 be allocated 80% of CARES Act funds, state coverage of deferred County revenues resulting from the Sales Tax Layaway Program, immediate authority to waive property tax delinquencies resulting from the crisis, protections and mitigations for 1991 and 2011 Realignment sales tax revenue, and cash flow assistance solutions to counties to address short-term needs.

I have had many conversations over the course of the past year to discuss other potential revisions that could be made to enhance the ordinance which would continue to promote the mitigation of negative impacts to our communities as well as enhance the potential for the industry to be successful which in turn allows for the county to collect Measure C and Measure K taxes.

- Decrease in minimum acre size for indoor grows
- Elimination of plant count limitations for small scale grows
- Addition of Processing Licenses in PDC

On April 28, 2020, your Board gave consideration to a draft Urgency Ordinance which, if adopted, would require the public to wear masks when in County facilities under the same conditions required of County employees by the temporary policy (see attachment) your Board enacted on April 21, 2020. Staff took your comments and made revisions to the draft, which is back before your Board for consideration today.
Based on the input of your Board, if this Urgency Ordinance is adopted, a supply of masks would be placed, for the public to access, at the front entrance of each County facility. Signage reminding the public of the requirements for masking would be placed in prominent locations throughout the public areas of all facilities.
Cost and availability of masks is varying considerably as we move through the COVID-19 crisis. For the Lake County Courthouse alone, we estimate foot traffic of approximately 1,000 persons each month. Based on what we currently have on hand, this location could be supplied with masks for as long as 8 weeks, provided there are no other demands for that supply. Depending on the status of the disaster at that time, restocking may prove difficult given the degree of stockpiling that seems to have become the norm.
If this Urgency Ordinance is adopted, numerous additional County facilities will also supply masks to the public and it is difficult to project the number that would be needed and the resulting costs. Using the DSS Director's projections for her busiest office, there is need for as many as 5,000 masks for the public each month in just that one location. At this time, the least expensive cost for masks staff has found, is approximately $0.38 each when purchased in volume, for the type pictured in the attachment.
Using, as an example, what is likely our two most heavily trafficked facilities, the Courthouse and the busiest DSS facility, with an estimated total of 6,000 persons in/out, our out-of-pocket cost to provide masks to the public is estimated at $2,500 per month, with tax and shipping. For the purpose of expanding upon this estimate, if we assume an additional 4,000 persons are in/out of all other County facilities in a given month, our total out-of-pocket cost would be in excess of $4,000 per month. If the County qualifies for reimbursement by FEMA and CDAA for this expense, we may be reimbursed later for all but approximately 6.25% of the total cost.
