County desires to continue contracting for the provision of indigent services with Lake Indigent Defense, LLP (LID) and requires additional time to explore restructuring options and complete negotiations.
To accomplish these goals, both County and LID mutually request to extend the contract term twelve (12) months from December 31, 2020 to December 31, 2021 and increase monthly amount of agreement previously agreed upon from One Hundred and Eighteen Thousand Dollars ($118,000) to One Hundred and Twenty Five Thousand Dollars ($125,000) beginning January 1, 2021.
The increased cost of $42,000 for this fiscal year will be adjusted at mid-year.

It was determined a priority of your Board to utilize up to $1,300,000 in CARES Act funding to assist small businesses affected by the COVID-19 pandemic.
RFP No. 20-22 sought Proposals from entities qualified to coordinate this important program. Lake County Economic Development Corporation (LCEDC) was the sole respondent, and an Ad Hoc committee of two Board members, Department Heads and staff assigned to monitor our CARES Act spending plan determined them to be qualified and well positioned to carry out this work on behalf of the County.
Businesses throughout Lake County with staffing of 1-20 full-time equivalents are encouraged to document up to $30,000 in financial impacts arising from the COVID-19 pandemic. Initial awards will be up to $20,000. Pending your Board's approval of this Agreement, applications for funding are expected to be accepted by LCEDC beginning October 21, 2020, and evaluated and awarded on a first come, first served basis. Funds will likely run out sooner, but December 9 is the latest date applications will potentially be accepted. It is a federal requirement any awarded funds be spent by December 30, 2020.
Staff worked with LCEDC to develop a streamlined application process, with small businesses eligible for funding on the basis of their demonstrated need. Where possible, documentation and other requirements were reduced. Eligibility will be directly determined by LCEDC, using County approved and federally compliant criteria, removing barriers to getting this funding in the hands of Lake County businesses that need it. Businesses that previously received Coronavirus relief funding can still apply, but any needs covered by other programs are ineligible - "double dipping" is prohibited under the law.
The Ad Hoc Committee recommends your Board approve the attached Agreement between the County and LCEDC, and authorize the Chair to sign.

As your Board recalls, when you first approved the COVID-19 Return to Work Protocol on May 19, 2020, you directed that it be reviewed every 30 days. Review and revisions have previously occurred on June 16, 2020, July 14, 2020, July 21, 2020, August 11, 2020 and on September 15, 2020.
As you know, staff fully expected that the Protocol would be a living document. Over the past month, your department heads have not reported any issues with application of the Protocol. However our Public Health Department has advised that a minor revision is needed, to be consistent with CDC guidelines. Per the CDC, if an employee tests negative following known exposure, s/he should still quarantine, since symptoms may appear 2 to 14 days after exposure to the virus. So, staff recommends deleting the statement indicating that an employee may return to work in less than 14 days if test results are negative.
I have attached a strike out version to illustrate the proposed change, along with a final version for approval.
I recommend your Board approve amendment to the protocol, with thirty day reviews to continue.

Attached, for your approval, is the Agreement between the County of Lake and Lake County Office of Education - Safe Schools Healthy Students Program for School-Based Specialty Mental Health Services for Fiscal Year 2020-21 to provide for services rendered during Fiscal Year 2019-20. Lake County Office of Education - Safe Schools Healthy Students Program provides specialty mental health services at the Highlands Academy in Clearlake. The children enrolled at this Academy have previously not been able to sustain placement in mainstream enrollment in the Konocti Unified School District. This program, through the continued support of Lake County Behavioral Health Services (LCBHS), has helped to decrease rates of truancy and school suspensions, while increasing appropriate behavior while in school, active participation in academia, and improving overall school functioning. Services provided at the Highlands Academy are making a difference in these children and youths lives. Under the Agreement, Lake County Office of Education as the approved Contractor for Lake County Office of Education - Special Education Local Plan Area (LCOE/SELPA), will provide Medi-Cal Specialty Mental Health Services to Lake County Medi-Cal beneficiaries who have been identified through LCOE/SELPA as eligible to receive services under the Educational Related Mental Health Services (ERMHS) program. As LCBHS has had a successful working relationship with LCOE and LCBHS would like to continue this working relationship in order to provide specialty mental health services within the schools, LCBHS is requesting to waive the formal bidding process pursuant to Lake County Code Section 38.2, as it is not in the public interest due to the unique nature of goods or services.

Attached, for your approval, is the Agreement between the County of Lake and Ever Well Health Systems for Adult Residential Support Services and Specialty Mental Health Services for Fiscal Year 2020-21. Ever Well Health Systems, which has multiple facilities throughout California, is a licensed Adult Residential Living Facility. The Board and Care Facility is specific to the needs of adult clients that require placement that provides a structured environment due to the mental health challenges. The structured environment offers a non-restrictive, supervised program which focuses on each resident's specific needs and interests. As LCBHS currently has clients placed at this facility, and as it is our goal to keep our clients placed at the lowest level of care possible, it would require extensive work to find new placement for these clients. In addition, changes in placement could cause the exacerbation of the client's symptoms, which could potentially result in moving the client to a higher, more expensive level of care. This purchase is being funded through a Flood Protection Corridor Program Grant we have obtained through the State of California, which funds 100% of the property acquisition and relocation costs. Prior to making an offer to the seller, an environmental review of the property and an appraisal was performed, and the State has reviewed and approved all aspects of this purchase - including the purchase of the Torrence/Vigil property and funding the difference in cost of their new property, which is referred to as "purchase differential". Torrence/Vigil entered into escrow for their replacement property with the understanding the State would fund the purchase, however on October 6th we were informed that the State was several weeks away from funding which has placed their escrow in jeopardy. Staff brought to your Board an emergency, extra-agenda item during your meeting on October 6th for consideration of a temporary loan to complete the property purchase, which your Board approved. At that time, we explained that a resolution would be required to modify the adopted budget for FY 2020-21, and today's item is intended to introduce that resolution, which is attached.

The Lake County Watershed Protection District (DISTRICT) and the Habematolel Pomo of Upper Lake Tribe (HPUL) intend to enter into a Memorandum of Understanding for the shared execution of the USRPA 2019-2022 Environmental Information Exchange Network Grant (GRANT).The purpose of this Memorandum of Understanding is to document a mutual understanding of the District and Habematolel Pomo of Upper Lake Tribe agencies with respect to their joint application, approval, execution, reporting, and continuation of the aforementioned grant.
Currently, there is not a local mechanism that provides access to relevant, long term, and high-quality, water quality data. Regional tribal groups have been essential in collecting and monitoring water quality from streams and lakes, but some of this data, while uploaded to the Water Quality Exchange, is inaccessible to some local and state stakeholders. Therefore, a need exists for a centralized and coordinated effort to discover, collect, assimilate, store, and provide accessible guidance for water quality data in Lake County with an exchange network or networks.
At the completion of this project, the availability of accessible water quality data will allow local, state, federal, tribal, academic, non-profit, and the general public to better manage and monitor valuable aquatic resources in Lake County, including those in Clear Lake.

The County of Lake received approximately $3,495,234 in a settlement earlier this year, due to the cause and impact of the Sulphur Fire in 2017. These funds have been allocated to Budget Unit 1920: Disaster Response/Recover.
Due to the fact that these funds were collected based on the trauma that was experienced by those directly impacted by the tragic fire of 2017 where a number of structures were lost in the unincorporated areas north-west of the City of Clearlake city limits and south of Clearlake Oaks, I would like to discuss on how we can use these funds to help revitalize that area.
I would like to offer that we use no more than $2.25 million for repairing roads in the area and no more than $250,000 to help subsidize permit fees for those rebuilding their homes that were lost . Between the upgraded infrastructure and decreased hardship of paying the fees to rebuild, this money would be well spent to boost the vitality of the area and enhance the interest in investing in the area for future growth.
This would allow us to use $2.5 million of the approximate $3.5 million that we currently have set aside, leaving us with $1 million left to save for future disaster response or to spend on other community needs.
Potential plan:
$2.25 million for road rehabilitation (i.e. Lakeshore Drive, North Drive)
$250,000 for subsidized permit fees (i.e. building permit)
Total - $2.5 million for community revitalization

Subject: Consideration of Allocation of Funds from PG&E Lawsuit Settlement
Executive Summary: (include fiscal and staffing impact narrative):
The County of Lake received approximately $3,495,234 in a settlement earlier this year, due to the cause and impact of the Sulphur Fire in 2017. These funds have been allocated to Budget Unit 1920: Disaster Response/Recover.
Due to the fact that these funds were collected based on the trauma that was experienced by those directly impacted by the tragic fire of 2017 where a number of structures were lost in the unincorporated areas north-west of the City of Clearlake city limits and south of Clearlake Oaks, I would like to discuss on how we can use these funds to help revitalize that area.
I would like to offer that we use no more than $2.25 million for repairing roads in the area and no more than $250,000 to help subsidize permit fees for those rebuilding their homes that were lost . Between the upgraded infrastructure and decreased hardship of paying the fees to rebuild, this money would be well spent to boost the vitality of the area and enhance the interest in investing in the area for future growth.
This would allow us to use $2.5 million of the approximate $3.5 million that we currently have set aside, leaving us with $1 million left to save for future disaster response or to spend on other community needs.
Potential plan:
$2.25 million for road rehabilitation (i.e. Lakeshore Drive, North Drive)
$250,000 for subsidized permit fees (i.e. building permit)
Total - $2.5 million for community revitalization

Pending ratification by the Lake County Deputy Sheriff's Association, presented today for the consideration of your Board is the Memorandum of Understanding (MOU) By and Between the Lake County Deputy Sheriff's Association and the County of Lake for October 21, 2020 - October 20, 2021.
Except as explained below, this MOU implements the CPS-HR Classification and Compensation
(CC) Study of October 2019 at 85% of market median (Market 85). Wages for the affected
classes will be paid at 85% of the mid-point of the 12 comparison Counties. Those included
small counties of comparable size as well as neighboring counties with which we directly
compete for talent. (Calaveras, Colusa, Glenn, Humboldt, Mendocino, Napa, Nevada, Sonoma,
Sutter, Tehama, Yolo and Yuba). This is the first CC study completed for Lake County since
2003.
However, wages for this Unit already exceed Market 85 levels, and as a result, the classifications are "Y-rated" for the time being. Y-rated classifications stay at their current rates of pay until cost-of-living-adjustments (COLA's) or other increases exceed the current rates of pay. The Y-rated %'s for each class are delineated in Article 2, at the request of LCDSA.
This MOU eliminates the 12-step salary system, replacing it with a 5-step system and restores
longevity pay for continuous services at 5 year intervals. A 5-step system is

Contract Change Order No. 1 addresses the balancing of all contract items to reflect the actual final in-place quantities and updates the project to current MUTCD standards.
This project is fully funded by the Highway Safety Improvement Program (HSIP) funds and California Toll Credit funds. Therefore, this project is 100% federally and state funded thru construction.

Mercer Fraser Company has completed the on-site work for the Anderson Springs Sewer Project. The project came in under budget and we are submitting the final balancing change order to reflect a decrease of $235,011.00 in the total contract amount.
Exhibit A, attached, lists the final changes in project costs.
The entire contract which was signed June 25, 2019 was for $1,926,995.00 and one change order in the amount of $23,688.00 brought the total to $1,950,683.00. The final balancing change order reduces the amount by $235,011.00 for a total contract price of $1,715,672.00.
All work has been completed as of September 30, 2020 and the new public sewer system is operating as designed. This portion of the project was funded by HCD- CDBG grant funds.
Recommended Action
