The County of Lake has generally submitted all public notifications to the Record-Bee. However, it has come to my attention that other local newspapers fit the criteria to being a "newspaper of general circulation". State law requires that we use a "newspaper of general circulation" in order to submit our public notifications and satisfy those obligations.
I have put together an RFQ that will solicit any and all news providers that meet the state's guidelines and can prove that they are a "newspaper of general circulation" to provide the county of Lake multiple avenues in which to submit our public notifications and possibly, with increased competition, provide smaller time frames and lower costs which would increase our efficiencies as a county.
The RFQ would have two timelines. One, we would create our initial list by April 30, 2021. Two, we would leave the RFQ open-ended so that any new agencies that meet the qualifications are capable of submitting an application and being added to the list in the future.

(Include fiscal and staffing impact narrative) Assembly Bill (AB) 14 prioritizes the deployment of broadband infrastructure in California's most vulnerable and unserved rural and urban communities by extending the ongoing collection of funds deposited into the California Advanced Services Fund (CASF) to provide communities with grants necessary to bridge the digital divide.
Although barriers to broadband connectivity have persisted for decades, the COVID-19 pandemic has highlighted the digital divide that separates Californians without internet connectivity from those who already have and depend on fast and reliable internet access as a normal part of their daily lives.
AB 14 recognizes that reliable internet connectivity is a critical necessity now, and that this will remain the case even after the COVID-19 pandemic has subsided. This bill equips Internet Service Providers, Local Governments, and Tribal Government funding to deploy or upgrade broadband services. Passage of this bill also ensures grants administered by the California Public Utilities Commission (CPUC) from the CASF are awarded to applicants who are willing and able to quickly and efficiently connect households, community anchor institutions, small businesses and employers.

As your Board is aware, United States Congressional Districts are revisited every ten years following the decennial Census Process. In California, as a result of 2010's Proposition 20, the Congressional Redistricting Initiative, responsibility for establishing new Congressional Districts rests with the California Citizens Redistricting Commission.
Geographical proximity and common interests bind Lake, Napa and Mendocino Counties, and we have long and effectively shared common Congressional representation.
The Resolution attached for your consideration urges the California Citizens Redistricting Commission to keep Lake, Napa and Sonoma Counties within the same United States Congressional District.
Staff recommends your Board Adopt the Resolution.

Executive Summary
I would like to ask the Board to adopt the attached Resolution which approves the Financial Plan between Lake County and USDA APHIS Wildlife Services for July 1, 2021 through June 30, 2022. The Financial Plan amount is $114,610. The previous agreement was $110,202. The revenue accounts for 62% of the budget and it originates from local property taxes.
Wildlife Services maintains an integrated wildlife damage management program in Lake County to protect residents, property, livestock, crops and natural resources from damage caused by predators and other nuisance wildlife. The Wildlife Services program provides Federal leadership in managing these issues. Federal trappers use wildlife damage management strategies that are biologically sound and environmentally safe. They work with State Fish and Wildlife when managing wildlife problems and strive to reduce damage caused by wildlife to the lowest possible levels while at the same time reducing wildlife mortality.

Attached, for your approval, is Amendment 1 to the Agreement between the County of Lake and Remi Vista, Inc. for specialty mental health services for Fiscal Year 2020-21. Remi Vista, Inc., located in Redding, is a Short Term Residential Treatment Program licensed by the State of California. The facility offers a more intensive program milieu. As Child Welfare Services or Probation are ultimately responsible for initiating the placement of Lake County children and youth, LCBHS is ultimately responsible for the reimbursement of any specialty mental health services these children and youth receive. LCBHS is requesting to waive the formal bidding process, pursuant to Lake County Code Section 38.2, as it is not in the public interest due to the unique nature of goods or services. After further review, the services provided under this Agreement are forecasted to come out below the contract maximum; therefore, Lake County Behavioral Health Services (LCBHS) would like to decrease this Agreement by $60,000 and re-allocate these funds to other contracts within the same level of care.

Executive Summary: Attached, for your approval, is Amendment 1 to the Agreement between the County of Lake and Remi Vista, Inc. for specialty mental health services for Fiscal Year 2020-21. Remi Vista, Inc., located in Redding, is a Short Term Residential Treatment Program licensed by the State of California. The facility offers a more intensive program milieu. As Child Welfare Services or Probation are ultimately responsible for initiating the placement of Lake County children and youth, LCBHS is ultimately responsible for the reimbursement of any specialty mental health services these children and youth receive. LCBHS is requesting to waive the formal bidding process, pursuant to Lake County Code Section 38.2, as it is not in the public interest due to the unique nature of goods or services. After further review, the services provided under this Agreement are forecasted to come out below the contract maximum; therefore, Lake County Behavioral Health Services (LCBHS) would like to decrease this Agreement by $60,000 and re-allocate these funds to other contracts within the same level of care.

The Department proposes using State Contract #1-18-23-20A which has utilized a competitive bid process to establish vehicle prices for the purchase of a 2021 Chevy 3500 Double Cab truck. This is a replacement for SD17X, which has a motor that is no longer functional and mileage that well exceeds 130,000 miles. This vehicle will be used primarily as a maintenance truck within the Southeast Regional Wastewater service area.
The District coordinated with Central Garage to utilize the State Contract for vehicle purchases. The State Contract is based on a competitive process Statewide and provides opportunity for local governments to recognize the same savings that are afforded to the State due to the volume purchasing of the State. Your Board will recall that there are two communications towers on Mount Konocti Buckingham Peak. One tower is owned by the County, while the other is owned by AT&T but resides on ground space owned by the County. US Cellular occupies a portion of AT&T's tower as a tenant and, under the terms of the Tower and Ground Space License Agreement executed in 2002, the County receives 50% of the rent paid to AT&T by US Cellular for their use of the tower space.
Since 2002 the Agreement has been amended several times to facilitate US Cellular's antenna upgrades. When such upgrades increase the tower load (thus reducing tower capacity), a rent increase is justified. US Cellular recently completed upgrades to their tower equipment which triggers such an increase.
Attached for your Board's consideration is the fourth amendment to the Agreement which provides for a monthly rent increase of $363.41 to be paid to the County in consideration of US Cellular's upgrades and makes other minor changes.

Subject: Approve Amendment No. 4 to the Tower and Ground Space Agreement on Mount Konocti with AT&T and US Cellular
Executive Summary: (include fiscal and staffing impact narrative):
Your Board will recall that there are two communications towers on Mount Konocti Buckingham Peak. One tower is owned by the County, while the other is owned by AT&T but resides on ground space owned by the County. US Cellular occupies a portion of AT&T's tower as a tenant and, under the terms of the Tower and Ground Space License Agreement executed in 2002, the County receives 50% of the rent paid to AT&T by US Cellular for their use of the tower space.
Since 2002 the Agreement has been amended several times to facilitate US Cellular's antenna upgrades. When such upgrades increase the tower load (thus reducing tower capacity), a rent increase is justified. US Cellular recently completed upgrades to their tower equipment which triggers such an increase.
Attached for your Board's consideration is the fourth amendment to the Agreement which provides for a monthly rent increase of $363.41 to be paid to the County in consideration of US Cellular's upgrades and makes other minor changes.

On May 27, 2020, the County of Lake entered into Standard Agreement 18-HOME-12585 with the Department of Housing and Community Development (HCD) for a $500,000 HOME Program Grant. On October 6, 2020, your Board approved both Intergovernmental Agency Agreements with Regional Housing Authority (RHA) to administer the County's First Time Home Buyer (FTHB) and Owner Occupied Rehabilitation (OOR) Programs utilizing the existing Program Income and new HOME Grant funds. RHA has updated the Program Guidelines for both programs, using templates provided by HCD and modifying them to meet our County's needs. These Guidelines have been approved for use by HCD and now require Board approval. With approval by your Board, the County, through RHA, can begin to use the guidelines to issue new FTHB and OOR loans.
The OOR program provides loans to low-income homeowners residing in the unincorporated areas of the county for the purpose of making repairs to their homes. The FTHB program provides loans to income-eligible homebuyers to purchase a home in the unincorporated areas of the county. A small down payment is required and the County loan must be coupled with a first mortgage. For both programs, eligible participants must be earning at or below 80% of the area median income (AMI), adjusted for family size as defined annually by HCD.

As your Board recalls, when you first approved the COVID-19 Worksite Protocol on May 19, 2020, you directed that it be reviewed every 30 days. Review has occurred on June 16, 2020, July 14, 2020, July 21, 2020, August 11, 2020, September 15, 2020, October 20, 2020, November 17, 2020, December 1, 2020, January 5, 2021, January 19, 2021, February 9, 2021 and on March 9, 2021.

(include fiscal and staffing impact narrative): In 2005, the former Lake County Redevelopment Agency entered into an Owner Participation Agreement (OPA) with Rural Communities Housing Development Corporation (RCHDC) for a 50 unit affordable housing project to be located at 6853 Collier Avenue in Nice, California.
The former Lake County Redevelopment Agency (RDA) had set aside twenty percent of its tax increment revenues to improve and increase the supply of affordable housing and, pursuant to the OPA, it agreed to use a portion of said monies to provide a loan to RCHDC to assist in the development of the Project.
The Owner's Participation Agreement was first amended in 2009 to increase the financial amount of the former Lake County Redevelopment Agency's participation. The initial loan amount of two hundred fifty thousand dollars ($250,000) which was secured by a Deed of Trust and Assignment of Rents recorded against the property located at 6853 Collier Avenue, Nice, California on April 7, 2005, was followed by an additional loan amount of nine hundred ninety-eight thousand dollars ($998,000), which was secured by an additional Deed of Trust against the Collier Avenue Property on June 8, 2009. Subsequently, six hundred and twenty-six thousand eight hundred and seventy-two dollars ($626,872) of the total loan amount was expended for pre-development costs.
As a result of Bx1 26 and the California Supreme Court case, California Redevelopment Association v. Matosantos, redevelopment agencies were dissolved effective February 1, 2012. On January 24, 2012, the Lake County Board of Supervisors adopted Resolution No. 2012-10 whereby the County of Lake elected to serve as the successor agency to the Lake County Redevelopment Agency and to assume the responsibilities, rights, and power of a successor agency pursuant to Health and Safety Code section 34177.
The County of Lake further elected not to retain housing assets and functions and pursuant to Health and Safety Code section 34176 and transfer to the Lake County Housing Authority all rights, powers, assets, liabilities, duties and obligations associated with housing activities to the Lake County Housing Authority. This transfer specifically included the loan receivable from Rural Communities Housing Development Corporation in the amount of $626,872 with the condition if the housing units were used for low income pursuant to the affordable Housing Covenant of the Owner Participation Agreement the loan is deferred and forgiven after 55 years.
To facilitate the winding down of redevelopment agencies, the State required that successor agencies to the redevelopment agencies be assigned to manage redevelopment projects underway when dissolution happened, make payments on outstanding debts, and dispose of the former redevelopment agency's non-housing assets. Each such successor agency has a seven-member Oversight Board that is responsible for overseeing the wind-down of former redevelopment agency's business and is comprised of representatives of local agencies that serve in the former redevelopment project areas.
On February 13, 2012 the Oversight Board of the successor Agency to the Lake County Redevelopment Agency directed the termination of the Owner Participation Agreement and the transfer of housing assets and obligations, including the encumbered amount in the housing fund to the Lake County Housing Authority.
On March 5, 2012, the Oversight Board of the Successor Agency to the Lake County Redevelopment Agency reconsidered the termination of the Owner Participation Agreement and instead made an order which included the following: 1) The County Housing Authority would cease distribution of any loan funds, 2) Repayment of money already disbursed would not be required at the time, 3) The County Housing Authority would retain second and third deeds of trust on the Collier Avenue Property; 4) the balance would be due and payable in five (5) years unless the Project is completed or substantial progress was made.
Although the transfer of all rights and obligations related to the Project was duly ordered by the Oversight Board of the Successor Agency to the Lake County Redevelopment Agency, no formal action was taken to assign to the County Housing Authority as the beneficiary of the deeds of trust securing the subject loan(s) by the former Lake County Redevelopment Agency.
This Resolution affirms the determination described in Lake County Resolution 2012-10 and includes the necessary actions needed to formally assign the deeds of trust securing the loans from the Lake County Redevelopment Agency to the Lake County Housing Authority.

6.103:00 P.M. - Discussion and Consideration of zoning ordinance amendment to Article 21-27 regarding the transition of applications impacted by the Farmland Protection Zone

The Planning Commission reviewed additional changes such as how to deal with applications impacted by newly created Farmland Protection Zone. The ordinance being proposed is based on the approved amendments AM 21-01 and CE-20-16. These are the amendments offered to provide an appropriate transition for applications for properties within the Farmland Protection Zone:
Applicants may be provided a three (3) year transition to meet the new compliance requirements of the Farmland Protection Zone if:
1. Applicants are deemed complete as of December 15, 2020
2. CEQA has been reviewed and completed its process
Recommendation 1: Those who can transition:
a) Commercial Cannabis Cultivation Permit Applications for projects located within the Farmland Protection Zone which were deemed complete but have not received a Use Permit before or on December 15, 2020 be excluded from the provisions of the Farmland Protection Zones for up to three years.
b) The Planning Commission of the County of Lake recommends that the language be expanded to include applications that were not deemed completed before December 15, 2020, as well as applications for projects located on parcels with Farmland Importance Designation. As of March 25, 2021, approximately 25 applications are within the Farmland Protection Zone with approximately 5 that are deemed complete based on the proposed language.
c) The Planning Commission recommends that the Board of Supervisors adopt language that provides guidance for applications that were not deemed complete by December 15, 2020; meaning that these projects would have to update the application project description to meet the ordinance before the permit could continue moving through the permit process.
ENVIRONMENTAL REVIEW
The Planning Commission of the County of Lake considered and adopted the Categorical Exemption for the aforementioned recommended adopted language to Article 27 and Article 15; as the activity in question here is merely a text amendment which will not have any effect on the environment, it clearly falls within the common sense exemption. The adoption and implementation of the proposed Zoning Ordinance text amendment, therefore, is exempt from CEQA. Pursuant to Section 15061(b)(3) of the California Environmental Quality Act (CEQA) projects "where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment" are exempt from CEQA.

Executive Summary: (include fiscal and staffing impact narrative):
The Planning Commission reviewed additional changes such as how to deal with applications impacted by newly created Farmland Protection Zone. The ordinance being proposed is based on the approved amendments AM 21-01 and CE-20-16. These are the amendments offered to provide an appropriate transition for applications for properties within the Farmland Protection Zone:
Applicants may be provided a three (3) year transition to meet the new compliance requirements of the Farmland Protection Zone if:
1. Applicants are deemed complete as of December 15, 2020
2. CEQA has been reviewed and completed its process
Recommendation 1: Those who can transition:
a) Commercial Cannabis Cultivation Permit Applications for projects located within the Farmland Protection Zone which were deemed complete but have not received a Use Permit before or on December 15, 2020 be excluded from the provisions of the Farmland Protection Zones for up to three years.
b) The Planning Commission of the County of Lake recommends that the language be expanded to include applications that were not deemed completed before December 15, 2020, as well as applications for projects located on parcels with Farmland Importance Designation. As of March 25, 2021, approximately 25 applications are within the Farmland Protection Zone with approximately 5 that are deemed complete based on the proposed language.
c) The Planning Commission recommends that the Board of Supervisors adopt language that provides guidance for applications that were not deemed complete by December 15, 2020; meaning that these projects would have to update the application project description to meet the ordinance before the permit could continue moving through the permit process.
ENVIRONMENTAL REVIEW
The Planning Commission of the County of Lake considered and adopted the Categorical Exemption for the aforementioned recommended adopted language to Article 27 and Article 15; as the activity in question here is merely a text amendment which will not have any effect on the environment, it clearly falls within the common sense exemption. The adoption and implementation of the proposed Zoning Ordinance text amendment, therefore, is exempt from CEQA. Pursuant to Section 15061(b)(3) of the California Environmental Quality Act (CEQA) projects "where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment" are exempt from CEQA.

Executive Summary (Include fiscal and staffing impact narrative): Staff was recently notified by our distinguished Congressman, Mike Thompson, that the 117th Congress of the United States has announced a Community Project Funding Program will be implemented for Fiscal Year 2022. This important program will direct funds to specific state or local governments to support community health, safety and economic well-being.
Members of Congress can submit up to ten (10) Community Project Funding proposals on behalf of jurisdictions within their District. Submitted projects will be competitively evaluated by the Committee on Appropriations. While there is no guarantee all will be funded, projects with strong local support will be given preference. Congressman Thompson is encouraging communities in his District to put forth only their highest priority projects that will enhance safety, create jobs and improve quality of life.
Considering these factors, and the input of the Economic Development Task Force, the following projects are proposed for consideration by your Board.
1. Lakeport Armory Facility Repurposing and Expansion for Wildfire Training:
The State is exchanging the Lakeport Armory Facility for a vacant property owned by the County of Lake, located in the City of Clearlake.
This project serves two primary purposes: 1) creating affordable housing in one of Lake County's most populous areas; and 2) relocating the Lake County Sherriff's Office, to provide for expanded use, including multi-agency Wildfire Training.
The County-owned property is located near a community college, a planned regional transit hub and other private and public services. It will be used for development of a housing project with at least 50% low-moderate income (LMI) units.
The state-owned Lakeport Armory property previously served the California National Guard; the facility is no longer in use. It will become a multi-purpose home base for the Lake County Sheriff's Office, addressing office space needs and providing a regional, multi-agency, multi-jurisdictional Wildfire Education/Training Center.
Estimated Community Project Funding Request: Not to exceed $1,000,000 dollars.
2. Full Circle Effluent Pipeline Preliminary Design Report Update:
The goal of the Full Circle Effluent Pipeline is to convey treated wastewater from existing Wastewater Treatment Plants (WWTPs) in Lakeport and Kelseyville around the south side of Clear Lake, and to inject this flow into the existing Southeast Geysers Effluent Pipeline (SEGEP) near Lower Lake, ultimately stimulating baseload renewable energy generation serving Lake and surrounding counties at Calpine's "The Geysers" geothermal field.
To maximize flexibility for effluent reuse and improve injection quality, as well as reduce pipeline-fouling potential, the effluent from both Lakeport and Kelseyville WWTPs may be treated to tertiary (California Title 22) standards. Additionally, for reliability and redundancy reasons, water may be drawn from Clear Lake and injected into the system, and water in the system may be used for agricultural irrigation along the pipeline alignment.
The project utilizes wastewater recycling to enhance and protect the water quality of Clear Lake while generating power with a low carbon footprint. Preliminary discussions with multiple partners previously involved indicates renewed interest and support for the project, because it would provide a more comprehensive public sewer system, while expanding use of wastewater to promote alternative energy production.
Estimated Community Project Funding Request: Not to exceed $500,000 dollars.
3. Pedestrian and Street Improvements:
a. Konocti Road Pedestrian Improvements Project consists of the construction of curb, gutter and sidewalk along Konocti Road from the Cole Creek Bridge to the entrance of the Kelseyville Elementary School.
Estimated Community Project Funding Request: $450,000 dollars
b. Reconstruction of a portion of the Nice-Lucerne Cutoff from the intersection of Lakeshore Boulevard to the State Highway 29 overpass.
Estimated Community Project Funding Request: $350,000 dollars.
Combined Community Project Funding Request: Not to exceed $800,000 dollars.
Recommended Action
Adopt the attached Resolutions, declaring these Lake County's highest priority projects for consideration of Community Project Funding, and authorize Chair to sign.

Three (3) Proposals were received and after careful review and consideration, the CSB ranked Luhdorff & Scalmanini, Consulting Engineers (LCSE) and Stantec Consulting Services the number one firm to be awarded RFP No. 21-02.
The project is fully funded from grant funds awarded to the District through the California Department of Water Resources (DWR) SGM Grant Program Planning - Round 3 Grant. The District was awarded $1,392,205.00 with a minimum local project cost share of $0, for the planning and development of the Big Valley Groundwater Sustainability Plan (GSP) for Big Valley Groundwater basin (5-015).
