Executive Summary

Both facilities provide Psychiatric Inpatient Hospital Services and Professional Services associated with Acute Inpatient Psychiatric Hospitalizations to clients referred by LCBHS. As LCBHS has had a successful ongoing working relationship with St. Helena Hospital and would like to continue this working relationship, LCBHS is requesting to waive the formal bidding process, pursuant to Lake County Code Section 38.2, as it is not in the public interest due to the unique nature of goods or services. Located in Nice, Ca. Manzanita House is one of two Board and Care Facilities located within Lake County that serve adults. As they are in County, clients placed at Manzanita House are actively engaged in Lake County Behavioral Health Services (LCBHS) services and can participate in their Recovery Program leading to positive outcomes and a successful return to the community. Manzanita House has proven to be a cost-efficient alternative for care for clients who are ready to be transitioned from Institutes for Mental Disease (IMDs) or have been brought back to the county from out of county placements. As LCBHS currently has clients placed at this facility and as it is our goal to keep our clients placed at the lowest level of care possible, it would require extensive work to find new placement for these clients. In addition, changes in placement could cause exacerbation of the client's symptoms, which could potentially result in moving the client to a higher, more expensive level of care. Attached, for your approval, is the Agreement between the County of Lake and Vista Pacifica Enterprises, Inc. for Adult Residential Support Services and Specialty Mental Health Services for Fiscal Year 2021-22. Vista Pacifica Enterprises, Inc. operates multiple facilities including Adult Residential Facilities and Skilled Nursing Facilities. Vista Pacifica Center is a 108 bed locked Institution for Mental Disease (IMD) facility with a Special Treatment Program (STP). The center has two separate units, one housing 48 bed for young adults and one housing 60 beds for the geropsych. This facility employs Master level Primary Counselors and Bachelor level Mental Health Counselors which is unique in most STP programs. Vista Pacifica Convalescent is a 49 bed secured SNF for the geropsych with behaviors and medical issues. This facility employs a Master's level Behavioral Specialist to work with the residents and staff. As LCBHS currently has clients placed at this facility and it is our goal to keep our clients placed at the lowest level of care possible, it would require extensive work to find a new placement for these clients. In addition, changes in placement could cause the exacerbation of the client's symptoms, which could potentially result in moving the client to a higher, more expensive level of care. Therefore, LCBHS is requesting to waive the formal bidding process, pursuant to Lake County Code Section 38.2, as it is not in the public interest due to the unique nature of goods or services. The funding requests are as follows: * CWDA has partnered with Justice in Aging, the California Elder Justice Coalition, CSAC, Urban Counties of California, CAPA, and the California State Association of PA/PG/PC to sponsor a budget request for $100 million in ongoing state funding to support the Adult Protective Services Program. The funding would enable the provision of long-term case management and expand and make permanent the Home Safe Program. * CWDA is co-sponsoring a budget request with Children Now to invest $50 million state funds in Year 1, and $100 million on going, to support statewide implementation of the Prevention Services provisions of the Family First Prevention Services Act (FFPSA). * CWDA is sponsoring a budget request for $9.5 million in funding to reinstate CalWORKs cash assistance grants for eligible parents whose children have been temporarily removed and placed into foster care while the parents are engaging in family reunification efforts. * CWDA is sponsoring a budget request for $100 million in one-time state funding to be spent over two fiscal years to create a flexible funding pool for county social services departments to fill service delivery gaps in the housing programs that the California Department of Social Services and county departments currently administer. Executive Summary

In order to raise awareness about National Prevention Week and the work done by Lake County Behavioral Health Services year-round, LCBHS staff request an audience with the BOS and also the community for a brief presentation during the 05/11/2021 BOS meeting. This presentation is estimated to take about 15 minutes, 5 of which are dedicated for a short question and answer period. National Prevention Week is an annual health observance dedicated to increasing public awareness of, and action around, mental health and/or substance use disorders. This week also falls during the month of Mental Health Awareness, however is especially dedicated to focusing on the power of prevention to ameliorate behavioral health challenges in our communities. Each year, National Prevention Week includes daily themes to focus on major substance use and mental health topics. The 2021 daily themes are: Monday, May 10: Preventing Prescription Drug and Opioid Misuse Tuesday, May 11: Preventing Underage Drinking and Alcohol Misuse Wednesday, May 12: Preventing Illicit Drug Use and Youth Marijuana Use Thursday, May 13: Preventing Youth Tobacco Use (E-Cigarettes and Vaping) Friday, May 14: Preventing Suicide National Prevention Week (NPW) is held each year during May. Originally, SAMHSA chose this timing because it is near the start of summer, an important time for school, communities, and prevention professionals to re-focus on prevention. Executive Summary

(include fiscal and staffing impact narrative): In 2015, your Board became aware of the fact that Robinson Rancheria had erected a gate on Foothills Oak Drive in Upper Lake. The portion of the roadway at issue was accepted by the County as a public roadway, but not accepted for maintenance purposes. During a regularly-scheduled meeting of your Board on December 15, 2015, you considered and approved the issuance of a letter to the Tribal Council of the Robinson Rancheria Band of Pomo Indians. In that letter, (a copy of which is attached here) your Board acknowledged the concerns of the Tribal Council which led to the construction of this gate, but also noted the concerns of area property owners that their ability to travel on a public roadway not be obstructed. The Board further indicated the intention of the County to initiate a dialogue with the Tribal Council with the goal of reaching a satisfactory resolution for all involved, but, in the meantime, the gate must be left open. This matter did not come back to your Board. However, action by the County may yet be taken and the matter is before you today for a discussion and consideration of possible action which your Board may take. Two statutes are of particular importance in the course of your discussion. The first is Streets and Highways Code section 1486, which provides: Gates shall not be allowed on any county highway except gates allowed by the board of supervisors in accordance with the provisions of section 966 . If the expense of the erection and maintenance of such allowed gates is not paid as required by section 966 , such gates shall be removed as an obstruction. Any person who leaves any such gate open, or who wi1fu11y and unnecessarily rides over ground adjoining the highway on which the gate is erected, shall be liable to the injured party for treble damages. Executive Summary

Pursuant to Chapter 6, Article 1 of the Lake County Code empowers the Director of Emergency Services to proclaim the existence or threatened existence of a local emergency when Lake County is affected by, or likely to be affected by a public calamity and the Board of Supervisors is not in session. During the existence of this local emergency, the powers, functions and duties of the Director of Emergency Services and the emergency organization of the County shall be those prescribed by state law, and by ordinance and resolutions of this County, approved by the Board of Supervisors, and by the Lake Operational Area Emergency Operations Plan, as approved by the Board of Supervisors. On April 21, 2021, the Governor of the State of California proclaimed a State of Emergency for the Counties of Sonoma and Mendocino due to extremely low reservoir levels and drought conditions. Inasmuch, Lake County water table levels are at significantly to critically low levels and are being continuously monitored. Based upon low water levels, the County may have to consider measures to address the water shortages. These measures may include taking steps to conserve water by practicing water conservation efforts, including, but not limited to repairing leaking plumbing, limiting non-essential watering, limiting car washing, filling bathtubs halfway or less, using high-efficient appliances, reducing shower times, only washing full loads of laundry, turning off water when brushing teeth or shaving, planting drought resistant landscaping and implementing other practices that reduce water consumption. Short or long-term solutions are costly; however, the County may be eligible for State or Federal assistance should the need arise to address drought issues if conditions persist. Therefore, the declaration of an emergency will allow the County to qualify for funding that has been specifically set aside for drought relief purposes. Programs within the State focus on ground water management, conservation and recapture/recycle initiatives. By declaring a local emergency, the County is taking a pro-active approach to address drought related disaster issues. In addition, with the adoption of a proclamation declaring a state of local emergency, State law requires the Board of Supervisors to review the status of the emergency at least once every 30 days.

Recommended Action

1. Adopt the attached Resolution Proclaiming a Declaration of a Local Emergency due to drought conditions. 2. Adopt the attached Resolution Proclaiming a Local Emergency and Requesting the Governor to make available State Assistance funding and seek all available forms of Federal disaster assistance and relief programs, to include Presidential Declaration of Emergency.

Executive Summary

(include fiscal and staffing impact narrative): As your Board is aware, Census data is collected every ten years. In the year following, Counties are responsible to undertake "Redistricting," to ensure that Supervisorial Districts are essentially equivalent, in terms of population. Significant changes have been made to relevant Federal and State law in the time since 2011. (a) In coordination with the Registrar of Voters and Information Technology, proposals were requested from four qualified potential contractors, and three responded (Redistricting Partners, Nielsen Merksamer and Prentice Long). A committee of County Department Heads and staff reviewed all three Proposals and met with the top two respondents. Ultimately, this group unanimously agreed Prentice Long was the entity best suited to meet the County's needs. Additionally, while Prentice Long is not unique in providing Redistricting Consulting Services, they were unique among the respondents in that Margaret Long will be dedicated to Lake County in the crucial six-week period late this year when we will have all relevant Federal Census data and State reconciliations. Prentice Long, PC, proposes to provide robust Redistricting Consulting Services, detailed in Exhibit A to the Agreement, enabling a transparent and well documented Redistricting process, with costs not to exceed $35,000. (b) Ms. Long's presentation, "Redistricting 101," will outline the Redistricting process and options available to your Board, changes to State and Federal law since 2011, and timelines necessitated by delays in Census Data delivery. Your Board may wish to provide direction to staff after considering this presentation.

(include fiscal and staffing impact narrative): I would appreciate your Board's approval of a record retention and destruction schedule to allow for the orderly retention, preservation, or disposal of documents. To support that process, I ask for your approval of my request that my office may destroy documents which are not required by law to continue to be maintained and which are no longer needed. Under California law, such documents may be destroyed if approved by the Board of Supervisors. I recommend that such destruction be authorized for specified records after the end of the retention periods listed in Exhibit A to the attached resolution. The retention periods are based upon the minimum retention periods as required by state and/or federal law for selected types of records maintained by my office. If your Board agrees to my request, the attached resolution may be offered for approval.

Executive Summary

(include fiscal and staffing impact narrative): Staff was recently contacted by the Yolo County Flood Control and Water Conservation District (YCFLWCD) following a request by the Cal Pine Corporation for an emergency water diversion from Clear Lake. As your Board is aware, Cal Pine utilizes water injection for the purpose of steam generation within their Geysers operations. The injected water consists of treated effluent from Lake and Sonoma Counties, as well as water diverted directly from Clear Lake. Cal Pine has notified YCFLWCD that the Sonoma County portion of injection water will be interrupted due to a construction project that will temporarily stop all flows from that region, and they have requested approval for an emergency water diversion from Clear Lake to replace the lost volume. According to Cal Pine officials, the amount of water being requested is 250 acre-feet of water, and they have requested an emergency Diversion and Use Agreement from YCFLWCD. Under normal circumstances this request would not be problematic, however with the certainty of drought conditions looming for Lake County, any intentional removal of water from the lake should be closely considered. YCFLWCD staff have respectively requested support for the diversion from Lake County, and due to the complexity of issues surrounding the request, staff is deferring to the Board of Supervisors for the decision. Staff offers the following information for your Board's consideration: * The requested amount (250 acre-feet) equals approximately 1/16" of water over the surface area of the lake; * During the peak summer months, the lake loses approximately 900 acre-feet of water, per day, due to evaporation; * According to Cal Pine, the emergency water will help prevent some serious maintenance and operational issues, as well as provide much needed fire suppression supplies. Additionally, Cal Pine suggests that if power generation is reduced or suspended due to low water supplies, this could have negative impacts to future geothermal royalties;

Recommended Action

Should your Board agree to support the request made by the Cal Pine Corporation, staff has prepared and attached a draft letter of support for your consideration. Should your Board disagree with the request, your vote to not prepare a letter of support will be sufficient.
