Executive Summary

(include fiscal and staffing impact narrative): The Middle Creek Restoration Project requires the local District to pay 25% of the total cost for construction design. The approximate cost of the construction design has been estimated at around $3.2 million. Our local District share would be $800,000. While the construction design process is still a ways away, we are attempting and have been attempting to get the Army Corps Engineer to start this process as soon as possible. While we have had many conversations with the Army Corps, the main problem is releasing appropriations from the federal government for our project. It has already been highlighted as a priority project, however, funding to get the construction design initiated has not materialized. As a committee, the Middle Creek Restoration Project committee feels that we would be more persuasive in requesting that funding be approved if we can show evidence that our share of the construction design funds have been fully allocated and are available. Current funds found in Budget Unit #1072 contain enough funding to allocate these funds as a new item allocation within the budget. Currently there are #9 items for allocation of funds for this budget unit. We request that a 10th item be added for the Construction Design of the Middle Creek Restoration Project in the amount of $800,000. 50% ($400,000) of the total amount can be taken from the allocation of item #1 Planning/Code Enforcement/Water Resources/Environmental Health. The other 50% ($400,000) of the total amount can be taken from allocation of item #3 Economic Development/Housing/Risk Reduction. The Middle Creek Restoration Project, as the board knows, is meant to increase water quality (this falls under the guise of water resources) and meant to provide better flood control as well as increase the water storage in our lake which would prove useful during drought seasons (this falls under the guise of risk reduction). We are asking the board to review these changes so that when the final draft of the budget, and final draft of cannabis tax allocations are approved that these changes are a part of the final document for us to review. Executive Summary

(include fiscal and staffing impact narrative): Lake County has participated in the Abandoned Vehicle Abatement Service Authority (AVASA) and the Abandoned Vehicle Abatement (AVA) Program since 1991. AVASA imposes a one (1) dollar vehicle registration fee plus an additional two dollars ($2) for Commercial Vehicles (CVRA) for a period of 10 years. Vehicle registration /service fees are annually imposed on each vehicle registered within the County. These fees are collected by the Department of Motor Vehicles and are used to reimburse participating jurisdictions in the County based on a formula that allocates available funding based on the jurisdictions' population percentage. County may extend this program in increments of up to 10 years and the adoption of a new Resolution is required to continue this program. Both the cities of Clearlake and Lakeport intend to continue with the program and have adopted similar Resolutions.

Recommended Action

Trainings cover various topics including Civil Rights, Welfare Fraud- Prevention and Detection, Accounting and Fiscal trainings, and even Field Safety Training. Many of these courses are required in order to comply with State regulations. The trainings not required by State law provide valuable information that would not be readily available or cost effective without the UC Davis contract. Because the vast majority of trainings are held at DSS, there are no venue costs to provide, and no meal, travel, or lodging reimbursements are necessary for employees attending. Furthermore, DSS and UC Davis adapted to COVID-19 regulations and transitioned trainings into an online platform, which increased flexibility and allows more employees to attend trainings. DSS increased the contract to include up to 57 possible units for use in fiscal year 21/22, in order to offer more options to employees. In fiscal year 20/21, LCDSS held 8 UC Davis training sessions, which was fewer than average due to many cancellations in response to COVID-19 restrictions. UC Davis has included a 7% Cost Share which provides the County with a $16,957.50 discount.

(include fiscal and staffing impact narrative): The Planning Commission is given a difficult task to deal with many applications that have been working their way through a rigorous process to be considered eventually in their meetings. During these meetings, water has become, rightfully so, a more sensitive subject matter due to our drought conditions. The Planning Commission has requested the board's assistance verbally multiple times on direction and guidance during these hard and difficult times where economic development and the urgent need to conserve water seem to be clashing. In the many planning commission meetings that I've observed, including the appeals that we have heard here at the Board of Supervisors, often times only well reports are provided. Well reports do not provide any scientific review on the impacts that the project may have and offer little to no information to allow our staff to analyze the cumulative impact these projects may have on the surrounding area. I offer an urgency ordinance that provides guidance to our Community Development staff that a hydrology report is required for all projects during the duration of our drought emergency declaration and that the applicants draft a drought management plan on how to take part in our community in conserving water in comparison to pursue the full potential of their projects. This would impact all projects as water is part of all projects currently being reviewed. Not applicable

Memorandum Date: July 27, 2021 To: The Honorable Lake County Board of Supervisors From: Bruno Sabatier, Chair and District 2 Supervisor Subject: Consideration of an Urgency Ordinance Requiring Land Use Applicants to Provide Enhanced Water Analysis During a Declared Drought Emergency Executive Summary: (include fiscal and staffing impact narrative): The Planning Commission is given a difficult task to deal with many applications that have been working their way through a rigorous process to be considered eventually in their meetings. During these meetings, water has become, rightfully so, a more sensitive subject matter due to our drought conditions. The Planning Commission has requested the board's assistance verbally multiple times on direction and guidance during these hard and difficult times where economic development and the urgent need to conserve water seem to be clashing. In the many planning commission meetings that I've observed, including the appeals that we have heard here at the Board of Supervisors, often times only well reports are provided. Well reports do not provide any scientific review on the impacts that the project may have and offer little to no information to allow our staff to analyze the cumulative impact these projects may have on the surrounding area. I offer an urgency ordinance that provides guidance to our Community Development staff that a hydrology report is required for all projects during the duration of our drought emergency declaration and that the applicants draft a drought management plan on how to take part in our community in conserving water in comparison to pursue the full potential of their projects. This would impact all projects as water is part of all projects currently being reviewed. (include fiscal and staffing impact narrative): The Community Development Department (CDD) Ad-Hoc Committee recommends to your Board adopting this ordinance to establish a temporary prohibition (moratorium) on the issuance of early activation (EA) permits for land use projects located within the unincorporated areas of the County of Lake. California Government Code 65858 grants the Lake County Board of Supervisors the authority to adopt an interim Urgency Ordinance to protect the public safety, health, and welfare of the residents of Lake County by prohibiting land uses that may conflict with a contemplated General Plan, Specific Plan, or zoning proposal that the County is considering, studying, or may study in a reasonable period of time. The CDD Ad-Hoc Committee has determined the following, 1) a prohibition (moratorium) is necessary in order to address a significant backlog of applications for EA permits and to ensure that such permits are not issued without a thorough consideration of the narrowly-prescribed circumstances pursuant to which such permits may be issued and 2) an Interim Urgency Ordinance is necessary to allow the Community Development Department sufficient time to study and assess various approaches to the land use permitting process to ensure that zoning regulations are developed whereby permittees are not delayed by an early activation process when a streamlined use permit process is more advantageous to effective land use planning, offers certainty to permittees, and fosters critical environmental review and public comment. This interim Urgency Ordinance shall take effect immediately upon its adoption by a four-fifths vote of your Board and shall continue in effect for forty-five (45) days from the date of its adoption. All EA applications submitted before the effective date of this Ordinance and deemed acceptable by the Community Development Department will be allowed to proceed in the review process.

These are the priorities below that we would like to discuss with the board to provide guidance and direction to our Code Enforcement team. Key priorities: - Illegal cannabis grows - Illegal water trucks - Hazardous vegetation B) We feel that with the administrative penalties, an urgency water truck ordinance, and an action plan for attacking these new priorities that a Code Enforcement Ad Hoc Committee should be created to work efficiently and collaboratively to move these action items along. Unique Nature of Goods/Services Recommended Action: (a) Waive the formal bidding process, pursuant to Lake County Code Section 38.2, as it is not in the public interest due to the unique nature of goods or services; and (b) Approve the Tenth Amendment to the Agreement between the County of Lake and Cerner Corporation for Anasazi Software and Support Services for Fiscal Years 2020-21 and 2021-22 for a sum of $95,000.00 and authorize the Board Chair to sign the Amendment.
On motion of Supervisor Simon, and by vote of the Board, Waived the formal bidding process, pursuant to Lake County Code Section 38.2, as it is not in the public interest due to the unique nature of goods or services; and approved Tenth Amendment to the Agreement between the County of Lake and Cerner Corporation for Anasazi Software and Support Services for Fiscal Years 2020-21 and 2021-22 for a sum of $95,000.00 and authorized the Board Chair to sign the Amendment.
