Executive Summary
(include fiscal and staffing impact narrative): Article X of Chapter Two of the Lake County Code is being amended to include further requirements for exemptions from competitive bidding as well as additional requirements for bid protests. Based on the direction received from your Board on 7/20/2021 staff is submitting this Ordinance for a first reading.
Section 38.2 is amended to include additional information regarding exemptions from competitive bidding. The additions are shown in bold below.
38.2 Not in the public interest. Notwithstanding the provisions of Section 2-39, competitive bidding is not required when the Board of Supervisors determines that competitive bidding would not be in the public's interest because of any of the following:
(1) A state of emergency,
A) An "emergency purchase" is a purchase made in response to an emergency as defined in Section 34.1(k) herein.
B) Section 42.1 and 42.2 herein provides further guidance.
(2) The unique nature of the goods or services precludes competitive bidding,
A) Use of this criterion requires documentation demonstrating both why the goods or services contracted are unique and why competitive bidding is precluded. Appropriate documentation shall be attached to the Memorandum to the Board of Supervisors at the time the item is submitted for consideration of Agenda placement.
(3) A determination that competitive bidding would produce no economic benefit to the County.
A) The cost of supplies, materials, equipment, or contractual services would not offer a large variation in the overall cost. The possibility of completing the competitive bidding process for new supplies, materials, equipment, or contractual services would offset any potential savings.
B) Competitive bidding shall be required every three (3) years.
C) Extensions during the three (3) year period shall not require competitive bidding.
Section 40.3 is amended to adjust the not to exceed amount of the local preference for informal solicitations. The changes are shown in bold below.
(b) In addition to the foregoing criteria, if the total combined quote amount submitted by a responsible local vendor is not greater than one hundred ten (110) percent of the apparent low quote and all other criteria being equal, preference shall be given to the responsible local vendor. However, in no case shall the amount of the preference exceed five thousand dollars ($5,000.00) two thousand five hundred dollars ($2,500.00), unless waived by the Lake County Board of Supervisors when it determines that a waiver would serve the best interests of the County and the public due either to the nature of the goods or services provided, the projected long-term costs to the County, or the ability to respond to the County's needs in a timely manner. This provision shall not apply to contracts required by State or Federal statutes and/or regulations to be awarded to the 'lowest responsible respondent' or otherwise exempted from local preference.
Section 41.3 is amended to adjust the not to exceed amount of the local preference for formal bids. The changes are shown in bold below.
(b) Local Vendor Preference. A ten percent (10%) preference shall be granted to Lake County local vendors on all sealed bids. However, in no case shall the amount of the preference exceed ten twenty thousand dollars ($120,000.00), unless waived by the Lake County Board of Supervisors when it determines that a waiver would serve the best interests of the County and the public due either to the nature of the goods or services provided, the projected long-term costs to the County, or the ability to respond to the County's needs in a timely manner. This provision shall not apply to contracts required by State or federal statutes and/or regulations to be awarded to the 'lowest responsible bidder,' or otherwise exempted from local preference.
Sections 46.1 and 46.3 are amended to include additional information regarding bid protests. The additions are shown in bold below.
46.1 Any party with a direct financial interest who is aggrieved by any alleged material irregularity in connection with the intended award of a bid, may file a bid protest with the Purchasing Agent or Assistant Purchasing Agent, where such protest is based on alleged violations of Federal, State, or local law or ordinance, or alleged material irregularity in either the County's bid invitation or in the bid to which an awarded is intended. Generally, non-material irregularities in a bid response are those that substantially conform to the bid requirements and do not affect the bid price, time or conditions in such a way as to affect the amount of the bid or provide a competitive advantage or benefit not allowed to other bidders. Material irregularities in a bid invitation provide a competitive advantage or benefit to one (1) bidder that is not enjoyed by other bidders. The Purchasing Agent or Assistant Purchasing Agent may determine whether an alleged irregularity exists and whether it is material or non-material and shall have the authority to waive non-material irregularities. A bid protest must:
(a) Be written,
(b) State the specific alleged violation of law or alleged material irregularity,
(c) Request a determination of the appeal,
(d) Provide a telephone number and email address at which the appellant can be contacted,
(e) Be filed no later than seven (7) days after the date of the Notice of Intent to Award Letter and/or formal Bid Opening (holidays excepted). Any protest filed after this time will not be considered.
46.3 Within seventy-two (72) hours of receipt of appeal, the Purchasing Agent or Assistant Purchasing Agent shall provide written notification to the appellant of the determination. A determination under this procedure shall be final except that the Purchasing Agent's or Assistant Purchasing Agent's decision may be appealed to the County Administrative Officer in writing within forty-eight (48) hours from the Purchasing Agent's or Assistant Purchasing Agent's notification to appellant.

Elijah House Foundation currently provides services in partnership with the County's Behavioral Health Services Department that includes case management, housing navigation, medication accountability, emergency shelter, employment development and placement and alcohol and narcotic support services at the former Juvenile Hall facility located at 1111 Whalen Way, Lakeport, CA. (APN: 21-1781-01).
Elijah House Foundation, in conjunction with Sierra Health and Wellness Centers, has indicated an interest in purchasing the former Juvenile Hall facility located at 1111 Whalen Way as a means to continue to provide and expand the community services they currently offer to Lake County residents.
The Space Committee supports this concept and recommends your Board designate a Negotiating Team to negotiate the sale of the property on behalf of your Board. Staff recommends that the Negotiating Team include County Administrative Officer Carol J. Huchingson, Assistant County Administrative Officer Susan Parker, Deputy County Administrative Officer Stephen L. Carter, Jr. and Behavioral Health Services Administrator Todd Metcalf.
The Negotiating Team will present the tentative purchase agreement reached for consideration and approval by your Board during a regularly scheduled and open Board of Supervisors meeting. If the purchase agreement is acceptable, staff will begin the process of surplussing the property in preparation of the sale.

Executive Summary
I would like to ask the Board to adopt the attached Resolution approving the Agreement with the California Department of Food and Agriculture (CDFA) for the Bee Safe Program in Lake County from July 1, 2021 through June 30, 2022. The agreement amount is $6,255.88.
The Bee Safe Program Agreement includes reimbursement for apiary registrations, training, and outreach, as well as other activities that are designed to protect bees and beekeepers from possible pesticide impacts.
Should the board adopt this resolution, please have the chair sign and return one copy of the agreement, one copy of the board resolution and return them to the Department of Agriculture for processing. A signed complete copy will be returned for your records.

Executive Summary:

As you will recall, on July 20th, your Board approved a contract between Lake County Behavioral Health Services and Elijah House to fund continued COVID-19 homeless shelter operations at old Juvenile Hall. As reported by Elijah House staff, Elijah House is confident that with this new funding they can continue to run the shelter at least through October 31, 2021. The County's Space Use Committee has provided ongoing support for the use of the former Juvenile Hall facility on a temporary basis for the purpose of a homeless shelter.
Elijah House has now been operating the COVID-19 homeless shelter out of juvenile hall for over a year now. Following my July 22nd presentation to the Space Use Committee, they extended their support of temporary use through December 31, 2021.
Staff recommends your Board adopt the Space Use Committee's recommendation, and extend temporary use of Juvenile Hall by Elijah House, as described herein.

Lake County Special Districts has been aware of a water leak in the water main crossing under Adobe Creek since earlier this summer and has been working on the design of a permanent solution which involves hanging the main on the bridge to remain out of the creek with construction activities. This process requires a structural engineering design and is not a quick process. We have been monitoring the leak and it has recently increased greatly in size.
Due to the urgent need to provide a bypass to ensure the community of Finley does not lose the public water supply the District requests that the Board waive the competitive bidding process as it would produce no economic benefit to the County and would delay the installation of the bypass. The proposed time and material contract has been evaluated with respect to current equipment and labor rates and an independent estimate is consistent with the proposed rates. Epidendio Construction of Lower Lake has provided Labor and Equipment rates consistent with State approved equipment rates and DIR approved prevailing wage rates for a time and materials based contract to construct the bypass. Epidendio Construction is certified in HDPE pipe fusion to and will work collaboratively with County staff to install a bypass securing an uninterrupted water supply for the community of Finley while the permanent repair project proceeds.
Attached for your consideration is the Agreement for Construction of Temporary Water Main Bypass at Adobe Creek Bridge in Finley with a not to exceed maximum of $35,000.

Phase One included a market analysis; development of a citizen participation plan, conceptual recreation center options, and cost estimates; identification of potential partners; analysis of project location opportunities surrounding the incorporated areas of Lake County; and organizational management recommendations. Last month the consulting team that completed the feasibility study presented the preliminary findings to the City of Clearlake, and earlier this month made a similar presentation to the City of Lakeport. Today is your Board's opportunity to receive the presentation.
Funding for the County's participation in the feasibility study - both Phase One and Phase Two - is included in the County budget through the Cannabis Internal Grant Program. Phase Two would include evaluation of the public survey results, further development of concept designs, more detailed operational analysis, and a final report to be presented to the participating governing bodies. The total cost for Phase Two is approximately $92,000, with the budgeted share for the County's contribution being $31,000. Our consultant Paragon Partners, Ltd. has reached an agreement for the purchase of property known as Assessor's Parcel Numbers 031-031-909 & 031-041-320 owned by Michael S. Mountanos, Trustee of the Michael S. Mountanos Living Trust. The purchase of this property will be a big step closer toward the development of the Middle Creek Flood Damage Reduction and Ecosystem Restoration Project.
The Purchase Agreement for the APN's 031-031-909 & 031-041-320 was approved by the California Department of Water Resources on March 3, 2021 for $1,371,000.00. The purchase of this property up to $1,371,000.00 is being completed using Grant funds provided by the State of California, Department of Water Resources, and the Flood Corridor Program following the provisions required by the Uniform Relocation Assistance and Real Properties Acquisition Policies Act of 1970.
The appraisal was prepared and presented by a third party hired by our relocation consultant, Paragon Partners, Ltd. Paragon Partners Ltd., received a counter-offer by the current owners broker in the amount of $1,000.00 more per acre. Paragon Partners Ltd. were notified that the counter-offer was deemed acceptable by Lake County as it is less than 10% above the appraised amount. As a result, Paragon Partners Ltd., drafted an Administrative Settlement outlining the increase of the First Written offer amount from $1,371,000.00 to $1,495,600.00.
The County sent the State for review and approval the Administrative Settlement with the purchase increase and were notified by the State that will not pay above the appraised value of $1,371,000.00 deeming the County responsible for compensating the additional $124,600.00 for the successful acquisition of APNS 031-031-909 & 031-041-320 located within the project area.
Recommendation
