Executive Summary

(a) This item is being submitted as an "extra" agenda item. The justification for this request to consider an item not on the posted agenda is as follows: This item came to my attention subsequent to the posting of the current agenda; and There is a need to take action before the next agenda. (b) On July 13, 2021, following a competitive RFQ process, our Board approved an Agreement with Trane for a preliminary energy audit. On September 21, 2021 the Board of Supervisors approved a Letter of Commitment for Trane to pursue grant funding toward a Firemain Linked Auxiliary Supply Hydraulic Energy Storage (FLASHES) system project in North Lakeport. Lake County's proposed project has caught the attention of the State, and the County has been invited to speak with the Governor's Office of Business and Economic Development (GO-Biz) on Monday, October 11. The conversation with GO-Biz could prove helpful in getting the grant funding required for the project to become reality. As Board Chair, I was invited to attend this meeting. On further conversation, Supervisor Scott was also requested to attend, in part because she is the Board's designated liaison with Sonoma Clean Power, a key regional partner that will also be represented. In the interest of transparency with the board, I wanted to provide an update on the status of the actions being taken so far for the project's funding, update the public, and get a consensus on the best team to meet with GO-Biz.

Recommended Action

(a) I recommend our Board take action by motion to accept this item for consideration as an "extra" agenda item; and (b) Approve recommendations to select Supervisor Scott and Supervisor Sabatier to represent Lake County at the upcoming Go-Biz meeting regarding the North Lakeport Energy Project.

Executive Summary

In early 2020, Lake County Behavioral Health Services (LCBHS), in partnership with the Lake County Office of Education (LCOE), applied for a Mental Health Student Services Act (MHSSA) grant, which was offered by the California Mental Health Services Oversight and Accountability Commission (MHSOAC). This competitive grant was designed to incentivize partnerships between behavioral health departments and education agencies for the purpose of increasing access to mental health services in locations that are easily accessible to students and their families. The grant was designed to provide support services that include, at a minimum, services provided on school campuses, suicide prevention services, drop-out prevention services, placement assistance and service plans for students in need of ongoing services, and outreach to high-risk youth, including foster youth, youth who identify as LGBTQ, and youth who have been expelled or suspended from school. LCBHS and LCOE designed a proposal that would include additional mental health staff for LCOE to provide services and increase access to mental health interventions. Unfortunately, due to the competitive nature of the grant, Lake County was not awarded the grant. However, one pandemic later, in April of 2021, the MHSOAC contacted Lake County about revising the grant for Lake County. The State of California was budgeting funding to assist youth and students returning to school with mental health needs brought about or exacerbated by the pandemic and using this grant as a means to distribute that funding. As Lake County was a close runner-up on their first round of funding, we were now at the top of the list for additional funding. LCBHS and LCOE agreed they were still interested in the grant, recognizing the need due to the pandemic. Following the passage of the State Budget in late June, MHSOAC was able to initiate the agreement. The Board adopted a Resolution on 09/28/2021 which authorized the behavioral health director to sign the standard agreement and grant claim form with the MHSOAC. Due to the requirements of the MHSSA grant, the funding will come to LCBHS, who will in turn distribute to LCOE. The agreement before the Board outlines the implementation of the MHSSA program. Both LCBHS and LCOE believe this is a great opportunity for the County and its students, bringing in funding to address the mental health needs of youth.

This competitive grant was designed to incentivize partnerships between behavioral health departments and education agencies for the purpose of increasing access to mental health services in locations that are easily accessible to students and their families. The grant was designed to provide support services that include, at a minimum, services provided on school campuses, suicide prevention services, drop-out prevention services, placement assistance and service plans for students in need of ongoing services, and outreach to high-risk youth, including foster youth, youth who identify as LGBTQ, and youth who have been expelled or suspended from school. LCBHS and LCOE designed a proposal that would include additional mental health staff for LCOE to provide services and increase access to mental health interventions. Unfortunately, due to the competitive nature of the grant, Lake County was not awarded the grant. However, one pandemic later, in April of 2021, the MHSOAC contacted Lake County about revising the grant for Lake County. The State of California was budgeting funding to assist youth and students returning to school with mental health needs brought about or exacerbated by the pandemic and using this grant as a means to distribute that funding. As Lake County was a close runner-up on their first round of funding, we were now at the top of the list for additional funding. LCBHS and LCOE agreed they were still interested in the grant, recognizing the need due to the pandemic. Following the passage of the State Budget in late June, MHSOAC was able to initiate the agreement. The Board adopted a Resolution on 09/28/2021 which authorized the behavioral health director to sign the standard agreement and grant claim form with the MHSOAC. Due to the requirements of the MHSSA grant, the funding will come to LCBHS, who will in turn distribute to LCOE. The agreement before the Board outlines the implementation of the MHSSA program. Both LCBHS and LCOE believe this is a great opportunity for the County and its students, bringing in funding to address the mental health needs of youth. LACO has been instrumental in reducing the number of cannabis applications that were unassigned to a planner. Our contract planner, Max Hilken, has assumed the review of 31 different cannabis applications from 3 different planners. Of those 31 applications, 6 are in the final review in preparation to appear before the Planning Commission. Mr. Hilken and associates have also provided immediate feedback and technical advice to the planners on a continuous basis, provided technical support for the Zoning Administrator hearings and continue to provide technical review and agency support for the Bar-X application. LACO planners are familiar with our cannabis ordinance and our processes and are available to immediately continue the work that they began in August. The compensation cap of the initial agreement has been reached and given the ongoing need for contractor support to address the backlog of cannabis project applications in CDD, staff issued a Request for Proposals on August 20, 2021. Executive Summary

Pursuant to Chapter 6, Article 1 of the Lake County Code empowers the Director of Emergency Services to proclaim the existence or threatened existence of a local emergency when Lake County is affected by, or likely to be affected by a public calamity and the Board of Supervisors is not in session. During the existence of this local emergency, the powers, functions and duties of the Director of Emergency Services and the emergency organization of the County shall be those prescribed by state law, and by ordinance and resolutions of this County, approved by the Board of Supervisors, and by the Lake Operational Area Emergency Operations Plan, as approved by the Board of Supervisors. On April 21, 2021, the Governor of the State of California proclaimed a State of Emergency for the Counties of Sonoma and Mendocino due to extremely low reservoir levels and drought conditions. Inasmuch, Lake County water table levels are at significantly to critically low levels and are being continuously monitored. Based upon low water levels, the County may have to consider measures to address the water shortages. These measures may include taking steps to conserve water by practicing water conservation efforts, including, but not limited to repairing leaking plumbing, limiting non-essential watering, limiting car washing, filling bathtubs halfway or less, using high-efficient appliances, reducing shower times, only washing full loads of laundry, turning off water when brushing teeth or shaving, planting drought resistant landscaping and implementing other practices that reduce water consumption. Short or long-term solutions are costly; however, the County may be eligible for State or Federal assistance should the need arise to address drought issues if conditions persist. Therefore, the declaration of an emergency will allow the County to qualify for funding that has been specifically set aside for drought relief purposes. Programs within the State focus on ground water management, conservation and recapture/recycle initiatives. By declaring a local emergency, the County is taking a pro-active approach to address drought related disaster issues. In addition, with the adoption of a proclamation declaring a state of local emergency, State law requires the Board of Supervisors to review the status of the emergency at least once every 30 days.

On September 21, 2021 your board authorized the Public Services Director to sign a purchase order for $177,519 to Leete Generators for two trailer-mounted emergency standby generators, to be paid from the CalOES allocation. The remaining $5,876 from the allocation is proposed to be used for smaller portable generators for satellite election locations. In accordance with County finance procedures for fixed assets, the purchase of the two large trailer-mounted generators must be appropriated in object code 62.74, equipment. The appropriation of capital assets requires Board of Supervisors approval, therefore staff recommends the Board of Supervisors approve the attached budget transfer to appropriate sufficient capital asset funds.

Executive Summary

Civil is a division of the Lake County Sheriff's Department. Its current software, Sirron Inc, is scheduled to cease operations at the end of 2021. On April 14, 2021, the Sheriff's Department issued RFP #21-07 for the replacement of the Civil Process System Management software. This software is necessary to run the day to day operations of the Civil Division. Bids were sent to Teleosoft, Inc, Tyler Technologies and Permitium as well as postings on both the County and Sheriff's websites. Two responses were received; Tyler Technologies and Teleosoft, Inc. A Consultant Selection Board (CSB), with the following panel members; Lt. Richard Ward, Assistant Chief Probation Officer Wendy Mondfrans, Operations Manager of the Superior Court Melissa Perry, IT Director Shane French, Retired Sergeant Steve Herdt and Sheriff/Coroner Administrative Manager Mary Beth Strong reviewed the proposals and provided their input on choice of system. Demonstrations were provided by both providers during separate sessions. In attendance at these sessions were both civil and fiscal staff members including Senior Law Enforcement Records Technician Laura Najd, Senior Accounting Technician Eugenio Ortega and Senior Staff Service Analyst Nancy McCarrick. All purchases are being paid from the Sheriff/Civil Budget unit 2207, object code 62.74 and are fully funded from civil fees so there is no cost to the County for this purchase. The annual maintenance is also paid from this budget. Costs for hardware upgrades and licensing has been determined by our IT Department. The Sheriff's Department requests authorization to issue a purchase order to Teleosoft, Inc in the amount of $49,500 to include any miscellaneous costs arising from the installation of this system and authorize the Sheriff to enter into a contract with Teleosoft, Inc. This service helps families to achieve the ultimate goal of self-sufficiency. In fiscal year 2020-2021, the Contract amount was reduced by $28,320 to better fit the needs of our clients and increase the efficient use of funds. The amount of monthly, unlimited use bus passes has been reduced and supplemented with punch cards that have a limited number of trips but no expiration date. These changes remain in the 2021-2022 Contract.

Executive Summary

On August 24, 2021, the Board of Supervisors approved an urgency ordinance prohibiting water hauling to unpermitted cannabis sites. After reviewing the changes that were made on the day it was approved, it became apparent that the changes made to the originally submitted ordinance prohibited the enforcement as it is not apparent as to what is a legal grow and what is an illegal grow for cannabis cultivation for water haulers. Upon further conversations about traditional agriculture, it was decided that since traditional agriculture does not rely on water trucks for crop cultivation that I would bring back an amendment to the ordinance to include all commercial agricultural operations including cannabis cultivation therefore helping to make this ordinance enforceable. There are exceptions to this ordinance such as grazing animals, the raising of small animals and poultry, domestic livestock farming, dairying, and animal husbandry. This is meant for commercial crop activity only. Also, it provides guidance that this ordinance shall not apply to hauling for the purpose of construction use nor for residential use. I am also requesting to reimplement a clarification for part of the cannabis ordinance that allows for water delivery during an emergency. I am again offering that a declared drought, one that is constant and known prior to harvesting this year is not an emergency that would allow for water delivery. Cannabis permits are provided based on land use reviews, providing water from unknown outside sources has not been reviewed and could be detrimental to other areas outside of the scope of the project if allowed to continue. On September 14, 2021, the Department of Cannabis Control (DCC) released draft guidelines for the Local Jurisdiction Assistance Grant Program. The goal of this grant, as authorized by the Budget Act of 2021 (SB-129), is to provide funding to local jurisdictions with commercial cannabis licensees needing the greatest assistance in transitioning from provisional licenses to annual licenses. Staff from the Administrative Office and Community Development Department have participated in providing requested data and comments on the program with DCC staff. There is $100 million allocated to this program. The County of Lake is currently eligible for funding up to $884,309 in Grant Program Funding, with an additional $1,216,834 available due to the County having created an Equity Program. At this time, a maximum total of $2,101,143 has been allocated to the County. Two of the eligible uses for funding include: - Local government review, technical support, and certification for application requirements. - Local government or other professional preparation of environmental documents in compliance with the California Environmental Quality Act for permits, licenses, or other authorizations to engage in commercial cannabis activity. Based on the information provided by DCC, Staff recommends the County engage contract professional services to support CDD in addressing the backlog of cannabis cultivation applications. Grant funds can be used to fund these services to both relieve the burden on CDD staff and expedite the processing of County permits. This will be enable those applicants to complete their local permitting process and receive their annual license with the state. Executive Summary

Based on your Board's direction to conduct diversity, equity and inclusion (DEI) training, and after obtaining three quotes from well-qualified trainers, I requesting your approval of an agreement in the amount of $8,000.00 with Nicole Anderson to provide two half day remote workshops for all Lake County management employees. DEI is a very important topic, as your Board is aware. However, all persons may not have the same level of awareness or know the most effective ways to discuss it in a safe and productive manner. Successful diversity training enables employees to become more comfortable with concepts such as unconscious bias at work and cultural competency and fosters, in employees, the habit of thinking about inclusion and how they can take actions that make the workplace more inclusive for everyone. I am recommending that every management employee attend these DEI training sessions with Nicole Anderson. Nicole Anderson has served in varying roles in education for more than 20 years around the state and nation. She is a highly qualified developer and facilitator of professional learning services as well as a dedicated advocate for educational equity work. Her current clients include CSAC, Vacaville City Council, Albany City Council, Solano County CSBA, state educational associations (ACSA, CSBA), various county offices of education, as well as multiple school districts around the state of California. Supervisor Crandell and I recently participated in Nicole's training sessions hosted virtually by CSAC, and despite the remote environment, found it to be highly effective and engaging.

The Sustainable Groundwater Management Act (SGMA), adopted by the State of California in 2014, prompts local agencies to better manage California's groundwater supplies over a long-term and in a sustainable manner. SGMA requires local agencies with medium- or high-priority basins to 1) form a Groundwater Sustainability Agency (GSA) and 2) develop and implement a Groundwater Sustainability Plan (GSP) by January 31, 2022. Lake County encompasses one (1) medium priority basin, the Big Valley Groundwater Basin (5-015).

Recommended Action

Marina Deligiannis, Deputy Water Resources Director / Big Valley GSPAC Lead, will give a presentation on the progress made for the Big Valley Groundwater Basin GSP. The update will include an overview of the GSP development schedule, key points of progress made on required GSP elements, highlights from GSP draft content, a call to action for review and input on the Big Valley Basin Communication and Engagement Plan, and a summary of the many ways the community can get involved in Lake County's SMGA-related efforts.
