Executive Summary
As your Board is aware, staff was recently contacted by Mendocino County officials regarding their need for short-term APCO services. In Mendocino County, these functions are handled by the appointed APCO who recently resigned and it is necessary to have an acting appointee in these capacities pending recruitment there.
APCO Douglas Gearhart is willing to provide needed support to Mendocino County for the term of the agreement and indicates that doing so will not negatively impact workloads for the Lake County Air Quality Management District (LCAQMD).
Pursuant to the attached MOU, with the approval of your Board, the LCAQMD will provide the services of APCO, Douglas Gearhart on a short term basis effective February 1, 2022 through April 30, 2022. In exchange for these services, Mendocino County will pay Lake County a total of $110.00 per hour up to a maximum of 10 hours per week. The MOU contains a 30 day termination clause should Mendocino County be able to fill its vacancy prior to April 30, 2022. It is anticipated that much of the work under this MOU will be performed remotely.
In addition to approving this MOU, staff requests your Board authorize the Chair to sign a Report of Appointment (ROA) document for Douglas Gearhart, to increase his pay by 20%, given that he will continue to work put in 100% time for Lake and an additional 20% for Mendocino, during the limited duration of this MOU

Your Board provided direction to suspend the pending cannabis tax rate increases that would be implemented pursuant to the Consumer Price Index. Executive Summary
Acute psychiatric inpatient hospitalization is a highly structured level of care designed to meet the needs of individuals who have emotional and behavioral manifestations that put them at risk of harm to self or others, or otherwise render them unable to care for themselves. Inpatient Psychiatric Acute Hospitalization services are an entitlement for Medi-Cal beneficiaries. And, regardless of insurance status, Mental Health Plans are financially responsible for County residents admitted to an Acute Psychiatric Hospital or Institute of Mental Disease (IMD) facility per California Code of Regulations � 1810.350: https://govt.westlaw.com/calregs/Document/IA4DA4B20E2E211DF8104A9E3DFB5B3E7?contextData=%28sc.Default%29&bhcp=1&transitionType=Default
The Crisis Team at LCBHS works diligently to place clients as quickly as possible and uses the most up-to-date hospital list from the Department of Health Care Services. It is important to note that the number of beds available in California is markedly limited, and finding a bed can be a challenge. Attached to this item is the most recent list of licensed Institutions for Mental Disease from the Department of Health Care Services, for reference. From 1995 to 2017, California saw a 27% reduction in the number of acute psychiatric hospital beds while the population increased by about 25%, see the most recent annual report from the California Hospital Association: https://calmatters.org/wp-content/uploads/2019/04/CHA-Psych-Bed-Data-Report-Sept.-2018.pdf
Acute Psychiatric Hospitals and IMDs have up to one year to submit an invoice for a client. This contract represents invoices dating back to August 2021. We have been working with the contractor to generate this contract since October and it went through editing with both the County and Adventist's legal team, which delayed the process. In years' past, we have had a separate contract for both Adventist facilities and engaged in single-year Agreements. The Agreement now before the Board includes both Adventist facilities with whom we place clients and spans two fiscal years, decreasing the administrative burden for the County and Department.

Executive Summary
On February 24, 2021, the Community Development Department (CDD) was awarded a State grant using Proposition 64 Grant funds to purchase a vehicle for the Code Enforcement Division. The purpose of the vehicle request was to be able to reach remote and/or inaccessible rural areas within Lake County as part of the Lake County's Cannabis Code Enforcement and Family WRAP grant project (contract #937-20).
Specifically, the grant included funds for the purchase of a vehicle to be used by Code Enforcement and Planning Staff for the inspection of cannabis operations - both legal and illegal. Staff has been working with a local vendor, Matt Mazzei Chevrolet, to secure a suitable vehicle, however we were recently advised that the vehicle we ordered has been re-directed to another dealer for retail sale. Today's item is for your Board's consideration of the purchase of an alternative vehicle through the State of California's State Contract.
Annually, the State of California's Procurement Division, complying with legal competitive bidding requirements, solicits vehicle bids throughout the State of California. A State Contract is issued to the low bidders and the results are published and distributed to local agencies. Local agencies are given the opportunity to purchase these vehicles through the state at the same cost as the State. Due to a lack of inventory, this is the only vehicle that could be found that closely matches the vehicle we ordered through the local vendor. The proposed replacement vehicle meets the requirements of the State grant, and it is within the available funding.
By approving this item, your Board concludes that this purchase is being made in accordance with Ordinance 3109 and Section 38.4 Cooperative Purchases of Chapter 2 of the Lake County Code, which allows the County to "piggyback" on other agencies competitively awarded contracts.

Executive Summary
Pursuant to Chapter 6, Article 1 of the Lake County Code empowers the Director of Emergency Services to proclaim the existence or threatened existence of a local emergency when Lake County is affected by, or likely to be affected by a public calamity and the Board of Supervisors is not in session. During the existence of this local emergency, the powers, functions and duties of the Director of Emergency Services and the emergency organization of the County shall be those prescribed by state law, and by ordinance and resolutions of this County, approved by the Board of Supervisors, and by the Lake Operational Area Emergency Operations Plan, as approved by the Board of Supervisors.
On April 21, 2021, the Governor of the State of California proclaimed a State of Emergency for the Counties of Sonoma and Mendocino due to extremely low reservoir levels and drought conditions. Inasmuch, Lake County water table levels are at significantly to critically low levels and are being continuously monitored.
Based upon low water levels, the County may have to consider measures to address the water shortages. These measures may include taking steps to conserve water by practicing water conservation efforts, including, but not limited to repairing leaking plumbing, limiting non-essential watering, limiting car washing, filling bathtubs halfway or less, using high-efficient appliances, reducing shower times, only washing full loads of laundry, turning off water when brushing teeth or shaving, planting drought resistant landscaping and implementing other practices that reduce water consumption. Short or long-term solutions are costly; however, the County may be eligible for State or Federal assistance should the need arise to address drought issues if conditions persist.
Therefore, the declaration of an emergency will allow the County to qualify for funding that has been specifically set aside for drought relief purposes. Programs within the State focus on ground water management, conservation and recapture/recycle initiatives.
By declaring a local emergency, the County is taking a pro-active approach to address drought related disaster issues. In addition, with the adoption of a proclamation declaring a state of local emergency, State law requires the Board of Supervisors to review the status of the emergency at least once every 30 days.

Executive Summary
The adopted work plan for the Area Planning Council (APC) in FY 21/22 included the development of Local Road Safety Plans (LRSP) for the two incorporated cities (Clearlake and Lakeport) as well as roads in the unincorporated areas of the County. The consultants who work with the APC, Dow and Associates/Davey-Bates Consulting, conducted a competitive procurement to hire a consultant to prepare the plans for the two cities, while the County Public Works Department elected to complete the LSRP using in-house staff. Unfortunately, shortly after beginning work on the plan, the key staff person assigned to the project left employment with DPW, and the Department now desires to have the consultant hired by the APC complete the plan. The LRSP is an important document to local agencies as it identifies locations in the road network that have safety deficiencies, and it is a prerequisite to be eligible for Caltrans Highway Safety Improvement Program (HSIP) grant funding.
Staff has contacted the consultant preparing the LRSP's for the cities, Headway Transportation, and they have provided a proposal to complete the plan for the County, which is attached. This cost, when compared to the cost to complete the studies for the cities, is commensurate with the respective scopes of work. As previously mentioned, Headway Transportation was selected as the most qualified consultant following a competitive proposal process, performed on behalf of the APC, and it is unlikely that there would be any benefit to performing another RFP process.
Staff proposes that this purchase is being made in accordance with Ordinance 3109 and Section 38.4 Cooperative Purchases of Chapter 2 of the Lake County Code, which allows the County to "piggyback" on other agencies competitively awarded contracts. By approving this purchase, your Board will concur with that recommendation.
It should be noted that the $50,000 originally budgeted through the APC will be available for this project, and staff has been advised we'll be able to seek reimbursement for the cost of the contract.
