EXECUTIVE SUMMARY:
Since 1969, California has required that all local governments (cities and counties) adequately plan to meet the housing needs of everyone in the community. California's local governments meet this requirement by adopting housing plans as part of their "general plan" (also required by the state). General plans serve as the local government's "blueprint" for how the city and/or county will grow and develop and include seven elements: land use, transportation, conservation, noise, open space, safety, and housing. The law mandating that housing be included as an element of each jurisdiction's general plan is known as "housing-element law."
California's housing-element law acknowledges that, in order for the private market to adequately address the housing needs and demand of Californians, local governments must adopt plans and regulatory systems that provide opportunities for (and do not unduly constrain), housing development. As a result, housing policy in California rests largely upon the effective implementation of local general plans and, in particular, local housing elements.
Staff recommends the Planning Commission report that the improvements is in conformance with the Lake County General Plan.

EXECUTIVE SUMMARY:

The project applicant is ALEX BECK proposing Commercial Cannabis Cultivation licenses consisting of (1) A-Type 3B (Medium Mixed Light), (1) A-Type 2B (Small Mixed Light), and (1) A-Type 1C (Specialty Cottage), to allow 69,120 square feet of cultivation area and 37,000 square feet of canopy. The project is located at 13306 Elk Mountain Road, and 13052 White Rock Canyon Road, Upper Lake and further described as APNs 002-023-90 & 002-023-93. Environmental Evaluation: Categorical Exemption. EXECUTIVE SUMMARY:
This is a request for four commercial cannabis licenses as follows:
* (1) A-type - 3B Tier 2 "Medium Mixed Light",
* (1) A-type - 2B Tier 2 "Small Mixed Light",
* (2) A-type - 1C Tier 2 "Specialty Cottage"
According to the applicant, the combined total mature canopy will be 37,000 square feet (s.f.). Cannabis plants shall be grown within 18 enclosed greenhouse structures with supplemental lighting, harvested, dried, graded, packaged, and stored onsite for final shipment. The combined cultivation areas are 69,120 s.f. The maximum combined cultivation area allowed by Article 27, subsection (at) is 73,560 s.f. based on a 50 acre parcel size.
The proposed cultivation sites are located on a +54 acre property located at 13306 Elk Mountain Road, Upper Lake. The lots are zoned RR-SC-WW-FF; Rural Residential-Scenic Combining-Waterway-Floodway Fringe. The site is almost entirely flat.
Immediate access to the site is taken from Elk Mountain Road, an unpaved narrow County road. The Project Site is not within a community growth boundary or an exclusion area.
Estimated construction time-frame is between 4 and 6 months. The staging areas are on portions of the lots that were previously disturbed with agricultural uses.
Staff is recommending Approval with Conditions of Use Permit (UP 18-29).
RECOMMENDED ACTION:
Categorical Exemption CE 19-48
I move that the Planning Commission find that this major use permit as applied for by Better Nature Farms LLC on property located at 13306 Elk Mountain Road and 13052 White Rock Canyon Road, Upper Lake, further described as APN: 002-023-90 and 002-023-93 is exempt from CEQA because it falls within Categorical Exemption Class 4 with the findings in the staff report dated July 29, 2019.
Major Use Permit (UP 18-29)
I move that the Planning Commission find that the Use Permit (UP 18-29) applied for by Better Nature Farms LLC on property located at 13306 Elk Mountain Road and 13052 White Rock Canyon Road, Upper Lake, further described as APN: 002-023-90 and 002-023-93 does meet the requirements of Section 51.4 of the Lake County Zoning Ordinance and the Major Use Permit be granted subject to the conditions and with the findings listed in the staff report dated July 29, 2019.
NOTE: The applicant or any interested person is reminded that the Zoning Ordinance provides for a seven (7) calendar day appeal period. If there is a disagreement with the Planning Commission, an appeal to the Board of Supervisors may be filed. The appropriate forms and applicable fee must be submitted prior to 5:00 p.m. on or before the seventh calendar day following the Commission's final determination
