The project applicant is the COUNTY OF LAKE DEPARTMENT OF PUBLIC WORKS proposing to construct a Class I multi-use path. The path would be approximately one mile long and 20 feet wide including a four-foot gravel equestrian trail bordered by an earthen drainage swale. The project is located within the State Route 29 right-of-way from the intersection with Rancheria Road to the intersection with Central Park Road, in the community of Middletown located in southern Lake County and will take place entirely within the right-of-way of State Highway 29. EXECUTIVE SUMMARY: Dan Kelly, owner of Munderloh's Calico Cat RV Park, is seeking approval of a new use permit to operate an existing RV Park located at 3297 East State Highway 20, Nice, CA. The park was originally established in 1941. The owner, Dan Kelly, acquired the park in 2009. The site had a fairly extensive history of violations, however all violations were corrected by the close of escrow in early 2010. The owner wants to re-establish the park as a legitimate use, thus this use permit was submitted and is under review. The original State license to operate this park had expired on November 30, 2005 according to County data. Approval of this Use Permit would enable the applicant to apply at the State Department of Housing and Community Development for a new State permit to operate the park. Staff recommends approval of Major Use Permit, UP 19-18. EXECUTIVE SUMMARY: The applicant proposes the addition of 15,694 sq. ft. to an existing 26,540 sq. ft. winery building, for the establishment of a large winery and tasting room with 225,000 cases annual production. The addition would include an 11,050 sq. ft. slab for outdoor storage of wine storage tanks, and 4,644 sq. ft. enclosed room addition for barrel and case goods storage. Production could increase in the future as bottling machinery gets replaced. Public use of the tasting room with incidental sales will continue, but no other events are proposed. Removal of 7,000 yd�of soil is proposed for the building addition, wine tank pad, and one-way driveway for delivery truck egress. There are two existing wells on the parcel, but only one is currently in use. The winery wastewater is cleansed by an on-site treatment system and then discharged into the County CSA #3 sewer, along with the tasting room and office wastewater. The site has an existing 20,000 gallon water storage tank for fire suppression purposes, and is connected to one 8" fire hydrant at the NE corner of the parcel. The buildings do not have sprinklers. The site is adjacent to Highway 20, but the encroachment is on Bartlett Springs Road. A one-way road will be constructed circling the parcel, for delivery trucks with a new 90' scale for weighing fruit. A loading bay will also be constructed, and parking spaces increased to 30 total, with 2 Accessible spaces. There is an unnamed waterway running along the western portion of the parcel, away from the proposed development. No serpentine soil is present, nor are sensitive species noted at this location on the 2018 California Natural Diversity Database. No tree removal is proposed. Staff is recommending Approval with Conditions of Use Permit (UP 18-46). EXECUTIVE SUMMARY: The applicant is proposing the following commercial cannabis licenses: * Area #1: A-Type 2 (outdoor); 9,317 square feet (s.f.) of cultivation area; 5,400 s.f. of canopy * Area #2: A-Type 1 (outdoor); 5,022 s.f. of cultivation area; 1,787 s.f. of canopy * According to the applicant's material submitted, the total cultivation area is 14,339 s.f. and the total canopy area is 7,187 s.f. Both cultivation areas are enclosed by a 6' tall fence. The +40 acre subject site is located at 18331 Ponderosa Trail, Lower Lake, and is known as APN 012-048-01. The subject site contains a previously approved medical cannabis cultivation area, a 730 s.f. 2-story barn that will contain gardening equipment and material storage (ground level), and cannabis drying (upper level). There are two existing residences on site; one of the residences will have a room that will contain surveillance equipment and will be used for cannabis packaging. The existing residences are served by an on-site septic system and a domestic well, which will also be used for cannabis irrigation. The house is served by an existing gravel driveway that takes access onto Noble Ranch Road, a private road that connects with Ponderosa Trail. The estimated water usage ranges between 75,000 and 112,500 gallons per year. This amount of proposed water usage is lower than other comparably sized outdoor cannabis cultivation licenses. The remainder of the parcel will remain in its current state of use with the two residences, a vegetable garden, and undeveloped forest land. The topography of the parcel is a saddle between two broad hills; the eastern portion of the site is flat; the western portion of the site has slopes in excess of 30%. The cultivation area slopes to the northwest toward Little High Valley. There are no wetlands/creeks on the property. Staff is recommending Approval with Conditions of MUP 18-53. RECOMMENDED ACTION: Mitigated Negative Declaration (IS 18-63) I move that the Planning Commission find that that the Initial Study (IS 18-63) applied for by Carol Littlefield on a property located at 18331 Ponderosa Trail, Lower Lake, further described as APN: 012-048-01 will not have a significant effect on the environment and therefore a mitigated negative declaration shall be approved with the findings listed in the staff report dated July 1, 2019. California's local governments meet this requirement by adopting housing plans as part of their "general plan" (also required by the state). General plans serve as the local government's "blueprint" for how the city and/or county will grow and develop and include seven elements: land use, transportation, conservation, noise, open space, safety, and housing. The law mandating that housing be included as an element of each jurisdiction's general plan is known as "housing-element law." California's housing-element law acknowledges that, in order for the private market to adequately address the housing needs and demand of Californians, local governments must adopt plans and regulatory systems that provide opportunities for (and do not unduly constrain), housing development. As a result, housing policy in California rests largely upon the effective implementation of local general plans and, in particular, local housing elements. Staff recommends the Planning Commission report that the improvements is in conformance with the Lake County General Plan.
