EXECUTIVE SUMMARY:
The applicant is requesting approval of a Minor Use Permit for Commercial Cannabis Cultivation (which includes the planting, growing, harvesting, drying, curing, grading, trimming, and/or any combination of those activities, including processing) M-Type 3 Outdoor License without the use of light deprivation and/or artificial lighting (Cannabis Outdoor Cultivation is the cultivation of cannabis without the use of light deprivation and/or artificial lighting in the canopy area. Supplemental low intensity lighting is permissible only to maintain immature plants as a source of propagation. For the purpose of this section, cultivation within a greenhouse without supplemental light is considered outdoor cultivation) within a previously graded, and/or disturbed area once used for commercial agricultural crops (vineyard/cattle). According to the applicant the project parcel, including surrounding parcels within the Benmore Valley has been used continuously for cattle and/or vineyards since the early 1950's. The project parcel is protected by the natural steep topography of the surrounding landscape and is accessible through an existing eighteen (18) foot wide graveled access easement off of Old State Highway 20.
The applicant is requesting approval of a Major Use Permit for Commercial Cannabis Cultivation (which includes the planting, growing, harvesting, drying, curing, grading, trimming, and/or any combination of those activities, including processing) for one (1) A - Type 3 Cultivation License for approximately 31,000 square feet of canopy area (cannabis cultivation site in square feet) of outdoor cultivation for adult use cannabis without the use of light deprivation and/or artificial lighting and two (2) Type 1C Specialty Cottage (Mixed Light) Licenses for the cultivation of medicinal or adult use cannabis of 2,500 square feet each (5,000 square feet in total) or less of total canopy size for mixed-light cultivation using light deprivation and/or artificial lighting below a rate of 25 watts per square foot, up to 25 mature plants for outdoor cultivation without the use of light deprivation and/or artificial lighting in the canopy area at any point in time, or 500 square feet or less of total canopy size for indoor cultivation within a permanent structure using exclusively artificial light or within any type of structure using artificial light at a rate above twenty-five watts per square foot on one premise. The applicant is also proposing a processing facility approximately 1,800 square feet in size and a storage shed of 180 square feet in size. The combined Cannabis Cultivation Area is approximately 37,920 square feet (Cannabis Cultivation Area, which is the designated area(s) at a licensed premises, except nurseries, that will contain mature plants at any point in time, as follows: Canopy shall be calculated in square feet and measured using clearly identifiable boundaries of all area(s) that will contain mature plants at any point in time, including all of the space(s) within the boundaries; Canopy may be noncontiguous but each unique area included in the total canopy calculation shall be separated by an identifiable boundary that includes, but is not limited to, interior walls, shelves, greenhouse walls, garden benches, hedgerows, fencing, garden beds, or garden plots and of mature plants are being cultivated using a shelving system, the surface area of each level shall be included in the total canopy calculation).

The site is located on a 37.23 acre parcel "Parcel" (APN 115-006-03) at 11275 Diener Drive, Kelseyville. The applicant is proposing two distinct areas for cultivation; 'Area A' (existing) is 11,100+ square feet of canopy within 12,000 square feet of enclosed cultivation area. 'Area B' (proposed) will be 26,500+ square feet of cultivation area and an undefined canopy size that will be equal to or less than 26,500 square feet and located within the Area B enclosure. General rules for cannabis cultivation areas include:
