6a.9:05 a.m. Public Hearing on consideration of a Minor Modification (MMM 16-03) to Parcel Map (PM 84-09). The project applicant is EDWARD & STEPHANIE HAWKS proposing two additional building envelopes on a +/-31.63 acre parcel. Original project was for a 5 lot parcel map. The project is located at 11650 Casa Grande Lane, Whispering Pines and further described as APN 013-059-01. Environmental Evaluation: Exempt pursuant to CEQA Section 15061(b)(3). (Mireya Turner)

EXECUTIVE SUMMARY:
Parcel Map (PM 84-09) was recorded in 1990, subdividing an approximately �198 acre parcel, into seven parcels, sizes varying �20 acres to �37 acres. The project parcel is �31.63 acres.
Building envelopes were established in Parcel Map PM 84-09 to protect known cultural resources, as well as sensitive species in the riparian areas and serpentine soils. The proposed buildable areas avoid these sensitive areas. They are far from waterways, serpentine soils and known cultural sites. A cultural resource study was conducted on the proposed building areas and no significant resources were found. The dwelling on the parcel was destroyed in the 2015 Valley Fire. The applicant proposes the addition of two new building envelopes, in order to rebuild their dwelling in a different location on the parcel. They wish to retain the current building envelope to preserve the ability to construct an accessory dwelling unit (Granny) in the future. An easement from Casa Grande Lane to the proposed building envelopes was recorded on June 5, 2018
In order to develop outside an established building envelope, the proposed locations for future development must be assessed for compliance with the General Plan, Zoning Ordinance, the Middletown Area Plan and California Environmental Quality Act. If the modification is approved by the Planning Commission, the County Surveyor will record the new buildable areas using a Certificate of Correction, pursuant to Section 66469 of the Subdivision Map Act.
Staff recommends Approval with Conditions.

I move that the Planning Commission approve the Minor Modification (MMM 17-01) to Parcel Map (PM 84-09) to allow the addition of two designated buildable areas for property located at 11650 Casa Grande Lane, Whispering Pines, with the findings listed in the staff report dated July 25, 2018.
NOTE: The applicant or any interested person is reminded that the subdivision ordinance provides for a fifteen (15) calendar day appeal period. If there is a disagreement with the Planning Commission, an appeal to the Board of Supervisors may be filed. The appropriate forms and applicable fee must be submitted prior to 5:00 p.m. on or before the fifteenth calendar day following the Commission's final determination.

Langtry Farms, LLC applied for a Grading Permit (GR18-016) on June 28, 2018. A revised project description and site maps were submitted on July 30, 2018 via email that reduced the acreage planned for development, after they had performed a review of their project needs. The grading permit application is to allow grading of approximately 575 acres of native vegetation on 10 parcels, in order to establish 10 new vineyard blocks. This acreage represents a reduction/correction from the original application materials that proposed 670 acres of vineyard over 13 blocks on 12 parcels. Pursuant to County of Lake Code Chapter 30, a Complex Grading Permit is required for the amount of grading proposed. Complex Grading Permits require California Environmental Quality Act (CEQA) review prior to issuance.
In August 2006 and March 2009, Analytical Environmental Services prepared the draft and final environmental impact reports (EIR) for Guenoc's proposed water rights modification project pursuant to CEQA. The EIR identified the subject vineyard blocks among the approximately 5,000 acres proposed for eventual conversion to vineyard. The current application represents 575 of the acres of vineyard blocks identified in the EIR. There have been approximately 10 other sets of vineyard blocks developed pursuant to this EIR document.
Middletown Rancheria submitted a letter on July 25, 2018 requesting a public hearing and a 30-day extension to facilitate tribal consultation for the grading project. Community Development Department Staff encouraged the applicant and Tribe to begin consultation while awaiting this hearing date.
Please note that two parcels were mistakenly listed in the legal notice. APNs 014-004-07 and 014-004-24 were inadvertently included in the "Cassidy" vineyard map; those two parcels neighboring the "Cassidy" vineyard parcel are not part of this development. The map has been revised to reflect the vineyard only on APNs 014-320-08 and 014-004-25.
RECOMMENDED ACTION:
Reconsideration of previously-approved EIR:
I move that the Planning Commission find that the Environmental Impact Report and mitigation measures that were previously prepared for Langtry Farms LLC for property located at 23400, 22100, 19862, 21423, 19506, Butts Canyon Road; 22500 Guenoc Valley Road; 24245, 23790, 23120 Bohn Valley Road; 25111 Grange Road, Middletown, CA, further described as APNs 013-023-15, 014-004-25, 014-310-07, 014-330-09, 013-022-01, 013-023-07, 013-023-10, 014-340-04, 014-320-08, 013-021-10 does meet the requirements of CEQA Guidelines Section 15162(a), and that no additional environmental review need be prepared.
Complex Grading Permit Approval:
