6a.9:05 a.m. Public Hearing on consideration of a Mitigated Negative Declaration based on Initial Study (IS 17-36) for Use Permit (UP 17-15) and Design Review (DR 17-09). The project applicant is VICTORIA CHRISTIE proposing construction of a new 14,100 square foot building for the headquarters of Roto Rooter. EXECUTIVE SUMMARY:
The owner / developer, Victoria Christie, is proposing to construct an approximately 14,100 square foot commercial building for her Roto Rooter headquarters, located at 3497 Stone Drive, Finley, CA, on a parcel totaling +1.47 acres in land area.
The property was originally zoned C2 / A (Community Commercial and Agriculture) until 2015. In 2015, the owner applied for a General Plan Amendment (GPAP 15-02) and rezone (RZ 15-04), which rezoned the property to its current zoning designation of C3-DR (Service Commercial - Design Review). An Initial Study (IS 15-24) was also prepared in 2015 to satisfy CEQA environmental review requirements. Lastly, a parcel map (PM 15-04) was processed which reoriented the lots in an east-west configuration.
Staff is recommending Approval with Conditions of this application.

I move that the Planning Commission find on the basis of the Initial Study No. 17-36 prepared by the Planning Division and the mitigation measures which have been added to the project, that the Use Permit and Design Review as applied for by Victoria Christie will not have a significant effect on the environment and therefore a mitigated negative declaration shall be approved with the findings listed in the staff report dated May 3, 2018.

I move that the Planning Commission find that the Use Permit (UP 17-15) applied for by Victoria Christie on property located at 3497 Stone Drive, Finley does meet the requirements of Section 51.4 of the Lake County Zoning Ordinance and that the Planning Commission has reviewed and considered the Negative Declaration which was adopted for this project and the Use Permit be granted subject to the conditions and with the findings listed in the staff report dated May 3, 2018.
Design Review
I move that the Planning Commission find that the Design Review applied for by Victoria Christie on property located at 3497 Stone Drive, Finley does meet the requirements of Section 54.5 of the Lake County Zoning Ordinance and that the Planning Commission has reviewed and considered the Mitigated Negative Declaration which was adopted for this project and the Design Review be granted subject to the conditions and with the findings listed in the staff report dated May 3, 2018.
NOTE: The applicant or any interested person is reminded that the Zoning Ordinance provides for a seven (7) calendar day appeal period. If there is a disagreement with the Planning Commission, an appeal to the Board of Supervisors may be filed. The appropriate forms and applicable fee must be submitted prior to 5:00 p.m. on or before the seventh calendar day following the Commission's final determination.

EXECUTIVE SUMMARY:
On June 27, 2006, the Board of Supervisors approved a tentative subdivision map (SD 05-13) for the division of approximately 7.11 acres to create 16 residential lots. Also approved was a rezoning of the property from Unclassified to R1 Single Family Residential (RZ 05-14), a Deviation (DV 06-03) and an Initial Study (IS 05-70).
The lots were originally approved to be connected to a public water system, Soda Bay CSA #20, and to individual septic systems on each lot. In 2011, the State imposed a moratorium for any new connections into this water system based on available water quantity and quality; this moratorium remains in effect today.
The applicant now seeks to reduce the total number of lots that would be created from 16 to 4; thus this Modification to the originally approved subdivision. Approval would change the 'subdivision' to a 'parcel map' based on the number of lots created.
The applicant is requesting to be allowed to connect to an existing on-site well.
The County's subdivision ordinance, Chapter 17, requires connection to a water system that is a 'reasonable distance' from a property if any are available. In this case the water lines are across Lakeview Estates Drive from the subject site.
The original Conditions of Approval (Attachment 2) are associated with the original approval. To date, none of these conditions have been met, and most must be met before the final map can be recorded for the proposed Van Eck parcel map with the exception of the road improvement conditions, which could be eliminated if this minor modification / parcel map application is approved.
Staff recommends Approval with Conditions, including connecting to a public water system.

B. Minor Modification to an Approved Subdivision Map:
I move that the Planning Commission approve the modification (MMM 17-01) to original subdivision (SD 05-13) to allow the reduction in lots from 16 to 4 for property located at 3640 Lakeview Estates Drive, Kelseyville CA, with the findings listed in the staff report dated May 3, 2018.
C. Parcel Map:
I move that the Planning Commission find that the Parcel Map applied for by John Van Eck on property located at 3640 Lakeview Estates Drive, Kelseyville CA, is in conformity with the provisions of the California Subdivision Map Act and Chapter 17 of the County of Lake Code and upon that basis, approve said map subject to the conditions provided and with the findings listed in the staff report dated May 3, 2018.
NOTE: The applicant or any interested person is reminded that the subdivision ordinance provides for a fifteen (15) calendar day appeal period. If there is a disagreement with the Planning Commission, an appeal to the Board of Supervisors may be filed. The appropriate forms and applicable fee must be submitted prior to 5:00 p.m. on or before the fifteenth calendar day following the Commission's final determination
