The project applicant is the COUNTY OF LAKE proposing recommendations to the Board of Supervisors for consideration of proposed amendments to CHAPTER 21, ARTICLE 27 OF THE LAKE COUNTY CODE TO REGULATE THE CULTIVATION OF CANNABIS. RECOMMENDED ACTION:
Staff recommends the Planning Commission take the following actions:
A. Find that the proposed text amendment to the Zoning Ordinance is exempt from the California Environmental Quality Act pursuant to Business and Professions Code Section 26055(h).
1. The project is consistent with the Lake County General Plan and Zoning Ordinance.
2. Adoption of the ordinance amendment will not have a significant effect on the environment.
3. The project will adopt ordinances, rules and regulations that will require discretionary review under CEQA to approve licenses or permits to engage in cannabis cultivation activities in the County of Lake.
B. Recommend that the Board of Supervisors approve the proposed Zoning Ordinance text amendments for the following reasons.
1. The proposed is necessary to maintain consistency with requirements of State law.
2. This proposal is necessary to protect the health and safety and welfare of the County.
3. Adoption of the ordinance amendment will not have a significant effect on the environment, and the project is exempt from CEQA.

SUBJECT: Proposed Amendments to Chapter 21, Article 27 of the Lake County Code

BACKGROUND
Staff is proposing amendments to Article 27 of Lake County Zoning Ordinance within Chapter 21 of the Lake County Code pertaining to the cultivation of Personal Adult Use, Qualified Patient, Primary Caregiver, and commercial cannabis. Staff recommends that the Planning Commission recommend that the Board of Supervisors approve the Zoning Ordinance amendments.
