EXECUTIVE SUMMARY: Please find attached the referenced FY 2013-14 Subvention Applications and the FY 2012-13 Year-End Financial Report. The application and report are based upon decisions and actions taken by your Board, ARB requirements, and the adopted budget. We are attempting to maximize the subvention award amount, but recognize full funding has not occurred for several years.
The requirements of the H&SC to report on and account for program expenditures and revenue on an annual basis is somewhat different than accrual practices, and is based on actual expenditures and revenue. If not properly balanced, the budget and report may result in a need to return subvention funds. The attached Year-End Financial Report is consistent with proper carry through, revenue and expenditures in the APCO's opinion as documented from prior year. The Subvention Application is based on the adopted budget.

EXECUTIVE SUMMARY:
The County awarded Phase I Archaeological Study on July 12th 2011 to Archaeological Services Inc. in the amount of $110,600. The phase I study was completed in January 2014.
Following the completion of phase I study, it was determined that a Phase II study was necessary to comply with federal requirements. Due to the expanded scope of work, the County opted to seek proposals for the Phase II study in lieu of amending the previous consultant agreement.
The Department requested proposals for the Phase II Archaeological services on July 6th, 2014. Three proposals were received from ALTA Archaeological Consulting, Archaeological Research and Archaeological Services Inc. On August 28, 2014, the Consultant Selection Panel reviewed the proposals and selected ALTA Archaeological Consulting as the best qualified archaeologist in accordance with the County policy for review and selection of professional consultants.
Funding for this project is as follows:
Federal Safe Routes to School (SRTS) $474,473
State Safe Routes to School (SR2S) $800,000
Local $338,327
CDBG $1,382,000
Total $2,994,800
This phase of the study will be paid for by the State Safe Routes to School fund with 10% local match.
Staff recommends that the Board of Supervisors approve the Agreement for Archaeological Services for the Clearlake Oaks Safe Routes to School Project with ALTA Archaeological Consulting in the amount of $65,000.00 and authorize the Chairman to execute said Agreement.

The Sheriff's Office is requesting your Board's approval to purchase replacement HVAC units for the Lake County Jail/Hill Road facility and the Administration building. The Sheriff/Jail budget unit 2301 currently has money allocated in object code 62.74 for this purchase. The amount for the jail facility totals $45,213.81 for 6 units. This will complete the replacement units on both Phase I and Phase II of the jail facility. The Sheriff/Coroner budget unit 2201 currently has money allocated in object code 62.74 for the purchase of five units at a cost of $24,310.09 for the Sheriff Administration building. The only units left to replace on the jail facility are the MAU's (make up air units) in the kitchen, which will be replaced at a later date.
Written quotes were provided by Baker Distributing and are attached for your review and approval. On June 19th 2012, your Board enacted Ordinance 2976 which established the Administrative Citation process for boaters found in violation of the County's Quagga Mussel Prevention Program. Under this ordinance, the enforcement officers have the option of citing a violation using an Administrative Citation instead of a Criminal Citation. For a first offense, the fine is $100; however the individual receiving the violation has the option to appeal the fine to your Board and today's item is a hearing for two citation appeals. I have provided a short summary of the case and I anticipate that the Appellant or a representative will be available to present their argument.
Mr. Taylor was cited by a Lake County Sheriff Boat Patrol officer on June 8, 2014. He was cited for violation of County Code 15.63 - Failure to display a current Lake County Quagga Mussel sticker. According to the incident summary provided by the officer, Mr. Taylor claimed he purchased a sticker from the engine repair shop that had performed some recent maintenance on his boat, and he assumed the shop had installed the sticker. Mr. Taylor indicated on his Request for Hearing form that the reason for his appeal is that the stickers were stolen from his boat without his knowledge. Staff researched our application records and found that Mr. Taylor actually purchased his quagga stickers on June 21, 2014. Copies of these documents are attached for your information. It should also be noted that Mr. Taylor provided information that he was aware of the annual sticker requirement and that he was a former volunteer ramp monitor.
Staff's Argument: The County Sheriff's Department has adopted a no-tolerance policy on violations of the County Quagga Mussel ordinance. The vessel owner was familiar with the requirements of the program and should have been aware that he was responsible for ensuring his vessel had the proper stickers prior to its operation on Clear Lake.
Recommendation
Only the Board of Supervisors can grant an appeal to the Administrative Citation. Your Board has supported the Sheriff's Department's policy on previous citation appeals and staff recommends that you follow your previous decisions.

SUBJECT: Consideration of Ordinance Adding Sections 706A.1 and 706B.1 to the Sewer Use Ordinance Pertaining to Sewer Collection System Capacity Fees for Connections to the Northwest and Southeast Regional Wastewater Facilities.
EXECUTIVE SUMMARY: On April 15, 2014, we addressed your Board regarding System Capacity Fee Evaluations and proposed adjustments within the CSA#21 North Lakeport Water system and the LACOSAN Northwest Regional Wastewater System. The staff recommendation was to establish conditions under which a reduced new construction apartment charge would apply when certain conditions were met; those being square footage not to exceed 800 square feet, low flow plumbing fixtures, a secondary source of water for landscaping and a dedicated laundry facility for tenant use only. The attached ordinance includes this category, as well as the expansion of the granny unit definition based on parcel size in order to be consistent with the Community Development Department's definition.
The attached Ordinance adds "TYPE OF CONNECTION" categories (2) and (4) which include reduced fee structures that meet the defined criteria, as approved by the Board in concept on April 15, 2014. The same categorical additions are included for this type of new construction discharging to the Southeast Regional Wastewater Treatment facility to be consistent.

On motion of DIrector Smith, and by vote of the Board (4 ayes, Director Comstock was ABSENT), advanced the ordinance two weeks, to November 18, 2014.
